Next Steps (near-term):

Since the petition contains a request for immediate action (for the NRC to immediately suspend the operating license for FitzPatrick), the PRB will convene Tuesday March 20, 2012, from 8:00am-9:00am, to discuss the request for immediate action only. Bhalchandra Vaidya is preparing a handout to facilitate the PRB's internal discussion and will coordinate with RI and NRR leads prior to the meeting for input. Bruce Boger, NRR Deputy Director For Reactor Safety Programs, will be informed of the PRB's decision (via the PRB Chairman) before the petition manager informs the petitioner. Please note

that communication with the petitioner (per MD 8.11) will need to be coordinated with other agency processes and/or communication plans.

The petitioner requested an opportunity to address the PRB in person (public meeting) before we make the initial recommendation to accept or reject the petition in accordance with MD 8.11. Please ensure that your calendars in Outlook are updated so that I can coordinate a date to support a public meeting with the petitioner. The purpose of the public meeting is for the petitioner to provide additional information in support of their petition request. The PRB is generally in listening mode, but may ask clarifying questions of the petitioner.

Following the meeting with the petitioner, the PRB will meet internally to make the initial recommendation (date TBD). Bruce Boger will be informed of the PRB's initial recommendation (via the PRB Chairman) before the petition manager informs the petitioner of the PRB's initial recommendation.

The petitioner will be offered a second opportunity, per MD 8.11, to address the PRB. If no new information provided, the initial recommendation becomes final and will be documented in either a closure letter (if the petition is rejected) or an acknowledgment letter (if the petition is accepted).

Please advise Bhalchandra and I if you have any questions.

Thanks, Andrea Russell 2.206 Coordinator Andrea Russell Project Manager Nuclear Regulatory Commission NRR/DPR/PGCB Ph: 301-415-8553 2
