December 10, 2009 BW090145 U. S. Nuclear Regulatory Commission Attention: Mr. Richard Skokowski 2443 Warrenville Road, Suite 210 Lisle, IL 60532-4352 Braidwood Station, Unit 1 Facility Operating License No. NPF-72 NRC Docket No. STN 50-456 SUbject: Response to NRC Follow-Up Inspection Report 05000456/2009007

Reference:

Letter from Steven West (U. S. NRC) to Charles G. Pardee (Exelon Generation Company, LLC), "Braidwood Station, Unit 1, NRC Follow-up Inspection Report 05000456/2009007; Preliminary Yellow Finding," dated November 30,2009

Dear Mr. Skokowski,

In the referenced letter, the NRC documented a finding preliminarily determined to be of Yellow safety significance. The finding is associated with failure of the "B" Train Containment Sump Suction Valve, 1SI8811 B, to fully open during surveillance testing in June 2009.

The referenced letter requested verbal and written notifications within 10 days of the date of the letter stating our intention to (1) attend a Regulatory Conference to present to the NRC our perspective on the facts and assumptions the NRC used to arrive at the finding and assess its significance, or (2) submit our position on the finding to the NRC in writing. In follow-up to our phone call on December 8,2009, which provided verbal notification of our intention to attend a Regulatory Conference on this matter, this letter provides written notification of the intention of Exelon Generation Company, LLC (EGC) to attend a Regulatory Conference regarding the preliminary Yellow finding. Braidwood Station requests a Regulatory Conference during the week of January 4, 2010. During the Regulatory Conference, EGC intends to present information that supports opening the 1SI8811 B valve by local manual operation. As requested, EGC will submit supporting documentation at least one week prior to the Regulatory Conference.
