MASSACHUSETTS INSTITUTE OF TECHNOLOGY - REQUEST FOR ADDITIONAL INFORMATION CONCERNING APPLICATION FOR LICENSE RENEWAL (TAC NO. MA6084)

Dear Dr. Bernard:

We are continuing our review of your July 8, 1999 application, responses to RAI received May 8, 2000, January 29, 2004, and February 22, May 29, August 15, August 21, and August 26, 2008 and associated supplements, for the renewal of the Massachusetts Institute of Technologys (MIT) Research Reactor Amended Facility Operating License No. R-37. During our review of your request, additional questions have arisen for which we require additional information and clarification. Please provide responses to the enclosed request for additional information within 30 days of the date of this letter. In accordance with 10 CFR 50.30(b), your response must be executed in a signed original under oath or affirmation. Following receipt of the additional information, we will continue our evaluation of your application request. NRC staff is conducting this review in accordance with the regulations and NUREG 1537 guidance.

Enclosure REQUEST FOR ADDITIONAL INFORMATION MASSACHUSETTS INSTITUTE OF TECHNOLOGY RESEARCH REACTOR DOCKET NO. 50-20

1. Under 10 CFR 50.33(d), Contents of applications; general information, certain information is required by the applicant, Massachusetts Institute of Technology (MIT), as applicable. To comply with the regulation, please update the application to include a statement of the organizational form of MIT (e.g., corporation, etc.), the state where it is incorporated or organized and the principal location where MIT does business, and the names, addresses and citizenship of directors and principal officers. Also, please state whether MIT is owned, controlled, or dominated by an alien, foreign corporation, or foreign government, and if so provide details.
2. Under 10 CFR 50.33(f)(2), the applicant shall submit estimates for total annual operating costs for each of the first five years of operations of the facility. Since the information in the applicants 1999 application is now out of date, please provide the projected operating costs of the Massachusetts Institute of Technology Reactor (MITR) for each of the years FY2009 to FY2013 (the first five year period after the projected license renewal) as well as MITs primary source(s) of funding to cover the operating costs for the above fiscal years.
3. The supplement to the application, dated May 29, 2008, indicates that that cost to decommission the MITR is $29,793,000 in 2008 dollars with a 10% contingency factor. The supplemental documentation also states that the escrow account will be revised to reflect

$29.8M. Since the staff needs additional information to complete its review, please provide the following:

(a) Provide a copy of the 2001 Duke Engineering and Services decommissioning cost estimate that was referenced in the Duke Executive Summary," and replaces the 1989 Conceptual Decommissioning Plan and Cost Estimates that was developed by General Electric Nuclear Energy.

(b) Provide MITs plans to adjust the level of funds in the escrow account periodically over the life of the MITR to meet changes in the decommissioning cost estimate.
