SUMMARY

OF TELEPHONE CONFERENCE CALL HELD ON JUNE 21, 2007, BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION AND WOLF CREEK NUCLEAR OPERATING CORPORATION, CONCERNING WATER USE OF JOHN REDMOND RESERVOIR BY THE WOLF CREEK GENERATING STATION The U.S. Nuclear Regulatory Commission (NRC or the staff) and representatives of Wolf Creek Nuclear Operating Corporation (WCNOC) held a telephone conference call on June 21, 2007, to discuss and confirm two items concerning water use by the Wolf Creek Generating Station (WCGS) during the proposed license renewal period. The NRC had two goals for this conference call:

1. To determine if WCNOC agreed that the NRC and its subcontractor Earth Tech were accurately interpreting the findings from a 2002 Corps of Engineer (COE) Environmental Impact Statement (EIS) concerning the water use availability of John Redmond Reservoir.
2. To determine if WCNOC has any long term definitive plans (or knowledge of long term definitive plans) to address the water shortage issue caused by the conservation basin silting up faster than expected.

With regard to item #1, the COE report summarizes that the conservation basin in the John Redmond Reservoir is silting up faster, due to uneven sediment distribution, than originally projected. Therefore, by 2014, water quantities less than currently allocated by the State of Kansas would be available to its users (including WCGS), during a once in 50-year drought period. WCNOC agreed that this statement was accurate, and that the COE, along with the State of Kansas, have begun discussions to address this issue. Some possible solutions under consideration range from raising the level of the John Redmond Reservoir in the short term to dredging the conservation basin in the long term.

With regard to item #2, WCNOC confirmed that they have no definitive plan or knowledge of a definitive plan by either the COE or the State of Kansas to address the water use issue associated with the John Redmond Reservoir. Although, as previously stated, WCNOC and the NRC are aware of the on-going discussions between the COE and the State of Kansas concerning the matter. However, the NRC and WCNOC were unable to ascertain or cite at this time any specific long term plan that definitively characterizes what the corrective measures will be.

Therefore, the goals of this conference call were satisfied. In summary, there will be a water use impact concerning the John Redmond Reservoir unless some corrected measures are taken before the proposed license renewal period (beginning 2025) for WCGS. As stated during this call, a range of environmental impacts to water use are being considered by the

NRC with regard to the draft Wolf Creek EIS currently being developed. Since the necessary corrective actions have yet to be determined, the NRC will have to evaluate WCGS inpacts to water use based on future events that have not been defined. The enclosure provides a listing of the participants. The applicant had an opportunity to comment on this summary.
