Dear Mr. Kansler:

The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed the Environmental Report submitted by Entergy Nuclear Operations, Inc., in support of its application for license renewal for the James A. FitzPatrick Nuclear Power Plant (JAFNPP) and plans to conduct its environmental site audit at JAFNPP during the week of December 4, 2006. To develop the Supplemental Environmental Impact Statement for JAFNPP license renewal, the NRC staff requests that the items described in the enclosed list be made available to the extent possible during the JAFNPP environmental site audit. James A. FitzPatrick Nuclear Power Plant License Renewal Information Needs The NRC staff has reviewed Appendix E, Environmental Report, of the James A. FitzPatrick Nuclear Power Plant (JAFNPP) license renewal application and have found that it meets the requirements of 10 CFR 51.45. However, in order to develop the Supplemental Environmental Impact Statement for license renewal, a number of informational needs have been identified and are outlined below. The NRC staff would appreciate if you could make the following documents available during the environmental site audit at JAFNPP to be conducted on December 5, 2006.

Documentation Non-Radiological Waste NRC staff would like to see a JAFNPP database or tracking system for non-radiological waste streams (how much waste is generated/disposed/treated).

NRC staff would like to see a copy of the JAFNPP Hazardous Waste permit and associated reports required by the State.

NRC staff would like to see a copy of the JAFNPP Hazardous Waste Minimization Plan as required by the State.

NRC staff would like to know if their have been any Hazardous Waste permit compliance audits or violations.

NRC staff would like to see a copy of the JAFNPP Waste Minimization Plan / Pollution Prevention Plan, if available.

NRC staff would like to see a copy of the JAFNPP Hazardous Waste Interim Status Authorization for storage of mixed wastes.

NRC staff would like to see a copy of the JAFNPP Hazardous Material Reg Certificate.

NRC staff would like to know if JAFNPP has filed any Emergency Planning and Community Right to Know Act reports.

NRC staff would like to see a list of all storage tanks that contain non-radiological liquid (biocides, oil, etc) within the boundary of the JAFNPP site.

NRC staff would like to see a copy of the JAFNPP Hazardous Waste Permit application.

NRC staff would like to know the amount of non-radiological waste generated in JAFNPP during the last five years (2000-2005). Non-radiological waste includes:

medical, office, hazardous, universal wastes, and sanitary wastes from the treatment plant.

Water & Permits NRC staff would like to see copies of the Updated permits (State Pollutant Discharge Elimination System (SPDES), Hazardous Material Reg. Certification, Hazardous Sub Bulk Storage, Water Withdrawal Registration) for JAFNPP. If an updated permit is not available then the NRC staff would need to see a copy of the permit renewal application.

NRC staff would like to know if JAFNPP has constructed additional outfalls for "intermittent discharges" as part of the SPDES renewal application, as stated in a 2002 letter from Entergy Nuclear Operations, Inc. (Entergy) to the New York Department of Environmental Conservation.

NRC staff would like to know the amount (liter/day) of the potable water used daily at JAFNPP and also if there is any restrictions on its supply.

NRC staff would like to see copies of the updated versions of the expired permits listed in Table 9-1 of the JAFNPP Environmental Report.

Air NRC staff would like to see a copy of the JAFNPP Certification to Operate Air Contaminant Source.

NRC staff would like to have a description of the onsite meteorological system.

NRC staff would like to have a description of the onsite air sampling systems.

NRC staff would like to see copies of Air permits and Compliance history for air quality.

Alternatives NRC staff would like Entergy personnel to provide details on Entergys site - specific conservation program. What does the program entail? Is there likelihood for additional gains? To what extent has Entergy already taken credit for future gains?

Radiological Protection NRC staff would like to see a copy of the Off-site Dose Calculation Manual.

NRC staff would like to see copies of the Previous 5-yr, Radioactive Effluent Release Reports.

NRC staff would like to see copies of the Previous 5-yr, Annual Radiological Environmental Operating Reports.

NRC staff would like to see a copy of the Updated Safety Analysis Report.

NRC staff would like to see copies of the Previous 5-yr, distribution of worker dose (dose range vs. number of workers) and total worker population dose (person-rem)

Socio-Economic Info Needs Education:

What school district is the plant in? What is the enrollment in that district? How much is spent per student in that district? How many school districts are in Oswego County?

How many enrolled total in county? What is the average class size? What is the average expenditure per student in the county? What is the enrollment, class size and average expenditure per student in Onondaga county? Include the source of this information so that the staff can cite it.

Traffic:

Is there any current information on traffic studies in the plant area, any references that can be used besides the Nine Mile Point Environmental Impact Statement?

Migrant Farm Labor:

Please provide the 2002 statistics on Migrant Farm Labor in Oswego and Onondaga Counties, if available. Specifically, information on how many temporary farm workers (working less than 150 days per year) were employed in each county.

Economy:

Please provide the most current employment numbers for Oswego and Onondaga Counties.

Please provide the most current information on the major employers in Oswego County and the number of employees each has.

Please provide the most current personal income data for Oswego and Onondaga County (total and per capita) and the states per capita personal income data.

Please provide unemployment rates for Oswego and Onondaga County and for the state of New York.

For the tax section the staff needs the total revenues for the year 2005 for Oswego County, Town of Scriba, and the Mexico Central Schools.

Terrestrial Ecology Data Needs NRC staff would like to see copies of the following documents:

Best management practices for ground-disturbing activities.

Environmental review procedure(s) used by site to evaluate changes to the facility.

Lists of all herbicides, pesticides, or other chemicals used in the transmission corridor or around the plant, and the amount, location, and manner of application.

Applicants on-site and transmission line vegetation management program plan, including timing of mowing, herbicide application, and clearing; inspections and repair activities conducted by helicopters or other vehicles; maintenance technician training programs or guidelines for applicant and any contractors; and any regulations which restrict maintenance activities (for instance state legislation restricting herbicide use in a portion of the corridor).

Names and contact information of any right-of-way contractors.

Information on management procedures around special species and in less developed areas of plant, for instance, brush removal programs near endangered species, wetlands, and water bodies Any reports to state or federal agencies regarding wildlife, including the death or injury of migratory birds, endangered species, or other unusual events.

If available, NRC staff would like to see copies of the following documents:

Any botanical surveys of transmission lines and site available that were conducted/commissioned by the applicant.

List of species that are of concern as disease vectors or pests.

Aerial photographs of site and transmission line(s).

Topographic maps of site and transmission line(s).

Habitat/vegetation/land use maps of site and transmission line(s).

Maps showing locations of known threatened and endangered (T&E) species occurrences.

Raptor and bat reporting procedures and records for transmission line(s).

Any procedures required by the Endangered Species Act biological opinion for the facility.

Documentation for environmental reviews for recently completed projects.

Documentation of consultation for T&E or wetland impacts.

Any relevant reference material regarding studies conducted in reference to terrestrial issues at the plant, including copies of any wildlife studies, plant surveys, and wildlife habitat certifications or applications.

Lists of any bird deaths (including birds of prey and migratory birds) which have occurred in the transmission corridor or at the plant or cooling tower.

Any documentation of how the applicant coordinates with state Department of Natural Sources and the U.S. Fish and Wildlife Service when carrying out maintenance activities at water, wetland, marsh, creek, or other critical habitat areas.

Any monitoring reports, surveys, any pre-activity surveys conducted in the last 20 years.

Any maps of vegetation communities (forest, wetland, scrub, etc.).

Information regarding historic sightings of threatened endangered species around plant or transmission corridors, including individuals foraging, nesting, or passing through.

Correspondence regarding T&E species with state and federal regulators.

Maps of ownership and land use on transmission lines and owner property.

Estimated acreage of vegetation communities.

Wildfire management plans.

Data on the number of migratory birds near area, including wintering waterfowl.

Meetings with JAFNPP Personnel Non-Radiological Waste NRC staff would like to meet with the plant personnel responsible for ensuring compliance with hazardous waste permit.

NRC staff would like to conduct a tour of JAFNPP accumulation and storage areas for non-radiological wastes.

Water NRC staff would like to meet with plant personnel with knowledge of the plants Wastewater system.

NRC staff would like to meet with plant personnel with knowledge of the plants storm drain system.

NRC staff would like to meet with plant personnel with knowledge of the plants once-through cooling system.

NRC staff would like to meet with plant personnel with knowledge regarding containers used for storing oil with a capacity of 55 gallons or greater. If the total volume of the containers used to store oil reaches 1320 gallons, the NRC staff will need to review JAFNPP Spill Prevention Control and Countermeasure Plan.

Land Use NRC staff would like to meet with plant personnel knowledgeable about the PILOT program (in-lieu taxes).
