SSW at HC I went through the entire CD recording of the NOED. Attached, in appropriate order, are what I believe to be the applicable important areas of the dicussion. (Scott has the entire CD)

In summary - as of the afternoon of 12/13 - the licensee said that the 14 a testing had been completed for all EDGs. They said that the testing for 14b and 14c had been completed on the A EDG and was in progress on the C EDG. They said that the 14b and 14c testing had been completed on the B and D EDG during the last refueling outage.

They said that all required testing to comply with the 14 spec 14, a, b, and c for all EDGs would be completed by about 5 PM on 12/13.

At the end of the call we made it clear that we would review their testing for adequacy and they acknowledged that it would be completed properly.

I think SSW would only apply if we think that they knew that the testing was not adequate. My belief is that their managemnt did not give it a sufficient review and as such did not identify that the testing was inadequate.

Nevertheless - it is worth bring this issue to an alleagtion panel, because we clearly stated that our granting the NOED was with the understanding the the testing would be completed properly.
