Please find enclosed the Vermont Department of Public Service Disclosure of Documents Pursuant to 10 C.F.R. § 2.336. I regret that I may have made a mistake in reading the regulation to mean that the required disclosures were only made to the other parties in a docket and not the Judges, with a confirmation to the Judges. At the Prehearing Conference held on Friday, January 21, 2005, it became apparent that the Judges wanted the list of disclosures and any privilege logs but not the hard-copy documents themselves. Accordingly, the Department of Public Service hereby files the Department's January 18' disclosure list with each of you, as well as the cover letter that accompanied the disclosure, the Certificate of Disclosure, the Certificate of Service used, and a copy of the confirming letter sent to the Judges.

January 14,2005 At this time, Mr. Sherman expects to rely upon the information in his possession included in the attached Disclosures as the bases for his opinions. As further relevant information comes into our possession, it will be disclosed as required by 10 CFR § 2.336.

As of today, Protective Agreements have not been worked out among the parties.

Accordingly, at this point we are sending the lists of all documents not being produced in hard copy to all parties, the hard copies of all non-proprietary documents to all parties, and two CDs, provided to us by Entergy in November 2004, that contain proprietary material, only to Entergy. Our Disclosure list of documents indicates which documents are claimed to be proprietary by Entergy. There are no documents generated by Department for which a proprietary claim is being made. If after looking at the lists,'any of the other parties would like any of the non-proprietary material from the list, and it wasn't provided in Entergy's disclosure, please let me know and I will have copies of the material made for you.

Additionally, the Department does have in its possession documents (primarily e-mails) that are privileged attorney-client material. The Department has reached an agreement with Entergy and the NRC Staff that this material is not subject to disclosure and that a privilege log for this material was not necessary.

If a party upon whom this disclosure is required, would like to come and view some of the disclosed materials as kept in the Department's files, please call me so we can arrange a mutually convenient time during normal business hours for that to occur.

Finally, please call me if you have trouble accessing any of the information that is described as to location, and I will provide whatever assistance I can to ensure your access to the information.
