Dear Secretary Vietti-Cook:

The Utility Workers Union of America, Local 369 ("Local 369") hereby withdraws its petition filed with the Nuclear Regulatory Commission on July 9, 2004 ("July 9 Petition"). The July 9 Petition, which was filed pursuant to 10 C.F.R. § 2.206 (2004), sought relief with respect to Entergy Nuclear Generation Company's ("Entergy") proposed contingency plans for continuing to operate the Pilgrim Nuclear Power Station ("Pilgrim") for the duration of a work stoppage.

Local 369 members voted in June to authorize a strike if a new collective bargaining agreement applicable to 300 Pilgrim workers was not reached prior to the expiration of the existing agreement on July 13. Yesterday, Local 369 members ratified a new collective bargaining agreement with Entergy, to which Local 369 had tentatively agreed on July 13. The ratified new collective bargaining agreement does not apply to approximately 100 Entergy employees who are represented by Local 369 in a separate bargaining unit, and for whom negotiations of a new collective bargaining agreement are on-going. However, in light of the ratification vote held yesterday, the immediate possibility of a strike at Pilgrim, which prompted Local 369's July 9 Petition, has been averted.
