Dear Ms. Vietti-Cook:

On Febniary 12,2004, the Connecticut Coalition Against Millstone (CCAM) filed a Petition to Intervene and Request for Hearing with regard to the renewal of the operating licenses for the Millstone Power Station, Units 2 and 3. The application of Dominion Nuclear Connecticut, Inc. (DNC) for renewal of the Millstone operating licenses is still undergoing an acceptance review by the NRC staff and has not yet been docketed.

Consequently, there is not yet any proceeding in which CCAM may intervene, and CCAMs intervention request is premature. DNC respectfully submits that CCAM should be directed to resubmit its intervention request after DNCs application is docketed and after the NRC issues a notice of opportunity for hearing. DNC will file any answer thereafter. In addition, CCAM should comply with the instructions in the notice of opportunity for hearing, including the directions for proper service upon counsel and the requirements established by final rule on Changes to the Adjudicatory Process, now in effect and applicable.
