The Nuclear Regulatory Commission has issued the enclosed Amendment Nos. 329, 329, and 330 to Renewed Facility Operating Licenses DPR-38, DPR-47, and DPR-55, respectively, for the Oconee Nuclear Station, Units 1, 2, and 3. The amendments consist of changes to the Technical Specifications (TS) in response to your application dated July 29, 2002.
The amendments revise TS Surveillance Requirement 3.7.2.2 to decrease the allowable closure time for the turbine stop valves from 15 seconds to 1 second.
A copy of the related Safety Evaluation is also enclosed. A Notice of Issuance will be included in the Commission's biweekly Federal Register notice.

SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NO. 329 TO RENEWED FACILITY OPERATING LICENSE DPR-38 AMENDMENT NO. 329 TO RENEWED FACILITY OPERATING LICENSE DPR-47 AND AMENDMENT NO.330 TO RENEWED FACILITY OPERATING LICENSE DPR-55 DUKE ENERGY CORPORATION OCONEE NUCLEAR STATION, UNITS 1, 2, AND 3 DOCKET NOS. 50-269, 50-270, AND 50-287
1.0 INTRODUCTION
By letter dated July 29, 2002, Duke Energy Corporation (the licensee) submitted a request for changes to the Oconee Nuclear Station, Units 1, 2, and 3, Technical Specifications (TS). The requested changes would revise TS Surveillance Requirement (SR) 3.7.2.2 to decrease the allowable closure time for the turbine stop valves from 15 seconds to 1 second.
2.0 REGULATORY EVALUATION
The regulatory requirements on which the staff based its acceptance are contained in Criterion 6 of the seventy General Design Criteria for Nuclear Power Plant Construction Permits proposed by the Atomic Energy Commission in a proposed rule-making published for Title 10 of the Code of Federal Regulations (10 CFR) Part 50 dated July 11, 1967. The General Design Criteria were part of the licensing basis for Oconee, and they are listed in Section 3.1 of the Oconee Updated Final Safety Analysis Report. Criterion 6 states, The reactor core shall be designed to function throughout its design lifetime without exceeding acceptable fuel damage limits which have been stipulated and justified. The core design, together with reliable process and decay heat removal systems, shall provide for this capability under all expected conditions of normal operation with appropriate margins for uncertainties and for transient situations which can be anticipated, including the effects of the loss of power to recirculation pumps, tripping of a turbine generator set, isolation of the reactor from its primary heat sink, and loss of all off-site power.
The turbine stop valves serve to isolate each steam generator from the other and to isolate the turbine from the steam generators following a high energy line break. In this manner, the turbine stop valves are part of the plant's systems that are used to satisfy Criterion 6.
3.0 TECHNICAL EVALUATION
Chapter 15 of the Oconee Updated Final Safety Analysis Report (UFSAR) discusses the expected response of the plant to various transients and accidents. Topical Report DPC-NE-3005-P, UFSAR Chapter 15 Transient Analysis Methodology, describes the licensees methodology for the Chapter 15 analysis of transients and accidents, not including loss-of-coolant accidents (LOCA).
By letter dated July 30, 1997, the licensee submitted DPC-NE-3005-P for the staffs review. In its letter dated April 23, 1998, Question 9, the staff noted that one of the turbine trip circuitry channels had a slower response time than the value assumed in the analysis methodology. In its response dated July 23, 1998, the licensee committed to modify this circuitry so that the response time would match the value that was assumed in the methodology described in DPC-NE-3005-P. The licensee committed to complete this modification on all three Oconee units by the end of the Spring 2001 refueling outage of Unit 2. The staff reviewed the licensees July 23, 1998, letter and the response to Question 9 and by letter dated October 1, 1998, approved DPC-NE-3005-P.
In its submittal dated July 29, 2002, the licensee stated that the modification to the turbine stop valve closure circuitry had been implemented on all three Oconee units. The proposed change to revise TS SR 3.7.2.2 to decrease the allowable closure time for the turbine stop valves reflects the implementation of this modification.
The staff concludes that the proposed change to TS SR 3.7.2.2 is acceptable since (1) this change matches the assumed value of turbine stop valve closure time that was used in the staff-approved methodology that was used in analyzing UFSAR Chapter 15 non-LOCA transients and accidents, and (2) Criterion 6, discussed previously in Section 2.0, is still met.
4.0 STATE CONSULTATION
In accordance with the Commission's regulations, the South Carolina State official was notified of the proposed issuance of the amendments. The State official had no comments.
5.0 ENVIRONMENTAL CONSIDERATION
The amendments change surveillance requirements. The NRC staff has determined that the amendments involve no significant increase in the amounts and no significant change in the types of any effluents that may be released offsite and that there is no significant increase in individual or cumulative occupational radiation exposure. The Commission has previously issued a proposed finding that the amendments involve no significant hazards consideration, and there has been no public comment on such finding (67 FR 56320). Accordingly, the amendments meet the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9). Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendments.
6.0 CONCLUSION
The Commission has concluded, based on the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.
