Dear Mr. Scalice:

Enclosed for your information is the synopsis of the Nuclear Regulatory Commissions (NRC)

Office of Investigations (OI) completed report regarding alleged discrimination by the Tennessee Valley Authority (TVA) against a former contract health physics technician. OI did not substantiate that TVA illegally discriminated against the individual.

Based on the OI activity described in the synopsis, we plan no further action with regard to this matter. Should you have any questions concerning this letter, please contact us.

SYNOPSIS This investigation was initiated by the U.S. Nuclear Regulatory Commission, Office of Investigations, Region II, on May 25, 2000, to determine whether the statements of a Tennessee Valley Authority, Watts Bar Nuclear Plant (WBN), health physics (HP) supervisor resulted in the nonselection for re-employment of a former contract worker at WBN by a dosimetry supervisor.

Based on the evidence developed during the investigation, it was determined that the dosimetry supervisor at WBN had legitimate, nondiscriminatory reasons for not rehiring the former contract worker. Therefore, this allegation was not substantiated.
