NRC Regulatory Issue Summary (RIS) 2007-08 Updated Licensing Submittal Information to Support the Desiqn-Centered Licensing Review Approach Florida Power & Light Company (FPL) provides the following voluntary response to NRC Regulatory Issue Summary (RIS) 2007-08.
Licensinq Submittal Information Question - Will the applicants be organized into DCWGs? If so, what is the membership and who is the single point of contact designated for each DCWG?
Have protocols been developed to provide coordinated responses for RAIs with generic applicability to a design center?
FPL Response FPL is currently evaluating the technologies associated with the facility designs.
FPL is desirous of participating with the Design Centered Working Group (DCWG) formed to implement the design-centered review approach (DCRA).
Once a technology is selected FPL will participate in a DCWG.
Question - Which applicant referencing the design will be designated as the R-COL applicant?
FPL Response FPL will select the R-COL for reference after the specific technology has been selected.
Question - When (month and year) will each of the COL applications be submitted for review? In addition, what is the design, site location, and the numbers of units at each site?

L-2007-111 NRC Regulatory Issue Summary (RIS) 2007-08 Page 2 FPL Response FPL is working to submit a COL application in March 2009. The application will be for two units of undetermined technology. The application will be based on two units at its existing Turkey Point site.
Question - What portions of the R-COL application (chapters, sections, subsections) will be relying on the Design Certification (DC)?
FPL Response Since a technology has not as yet been selected, it is too early for FPL to provide with any certainty or specificity those portions of the R-COL applications that will be relying on the DC.
Question - What portions of the R-COL application (chapters, sections, subsections) will be referenced (i.e., replicated verbatim) in S-COL applications and what portions of the application are likely to be site-specific?
FPL Response Since a technology has not as yet been selected, it is too early for FPL to provide with any certainty or specificity those portions of the R-COL applications that can be replicated or will require modification to accommodate site-specific information in an S-COL application.
Question - When (month and year) will applicants complete the detailed design information to be verified under those inspections, tests, analyses, and acceptance criteria that are directed at certification information (design acceptance criteria)? Will this information be completed in a design certification amendment application, in the R-COL application, in S-COL applications, in post-COL Final Safety Analysis Report Updates, or a combination thereof?
FPL Response Since neither a technology nor a COL vendor has been selected, it is too early for FPL to provide a schedule pertaining to verification of design information or how the information will be completed.
Site and Environmental Information Question- Do any applicants intend to apply for an Early Site Permit (ESP) prior to submitting their COL applications. If so, when (month and year) would the proposed ESP be submitted to the NRC for review?
FPL Response FPL does not currently plan to submit an ESP prior to submitting the COL application.
L-2007-111 NRC Regulatory Issue Summary (RIS) 2007-08 Page 3 Question - For ESP applicants, is the applicant going to be seeking approval of either "proposed major features of the emergency plans" per 10 CFR 52.17(b)(2)(i) or "proposed complete and integrated emergency plans" per 10CFR 52.17(b)(2)(ii)?
FPL Response FPL does not currently plan to submit an Early Site Permit (ESP) prior to submitting the COLA, therefore this question is not applicable.
Question - Do the applicants plan to submit an environmental report or limited work authorization request prior to other portions of the COL application, and if so, when (month and year)?
FPL Response FPL has not made a decision on whether or not to submit an environmental report or a limited work authorization request prior to other portions of the COL application.
Question - What scope and schedule do applicants project for site characterization activities, such as core borings and testing of core samples?
FPL Response FPL has not selected a technology or a COL vendor yet, and as such does not have a firm scope or a schedule regarding site characterization activities.
However, in order to support a March 2009 COLA filing target, FPL plans to initiate site characterization activities in January 2008.
Question - What interactions have taken place with local and state authorities and other Federal agencies to support licensing new reactors?
FPL Response FPL has currently filed a Public Hearing Application with Miami Dade County, Florida as part of its consideration of use of the Turkey Point site. FPL is also engaged in preparation of a need petition which will be filed with the Florida Public Service Commission. It is expected that both processes will come to conclusion by the end of 2007. COL application preparation will begin following the completion of these steps.
L-2007-111 NRC Regulatory Issue Summary (RIS) 2007-08 Page 4 Plant Construction Requirements Information Question - Who are the vendors and consultants that are assisting in the preparation of the application? The NRC requests that the potential applicants submit a list of entities that are providing input to and are preparing the COL application under a QA program.
FPL Response FPL has not selected a COL vendor and is not currently active in the preparation of a COL application.
Question - What information do the applicants have regarding the timing of construction, the ordering of long lead time components, and other commitments to construction? Furthermore, what vendors will be designing, manufacturing, fabricating, and testing safety-related components for eventual plant construction?
FPL Response FPL has not selected a technology, COL vendor or construction vendor yet, and as such does not have information regarding construction schedules or activities.
