Dear Mr. Collins:

Section IV of the Nuclear Regulatory Commission's February 25, 2002 Order Modifying the Operating Licenses issued to Florida Power & Light Company ("Order") states that, in accordance with 10 CFR 2.202, a licensee must submit a response to the Order and request a hearing on the Order within 20 days of the date of the Order.

In addition, the Order states that for good cause shown, the NRC will consider extending the time to request a hearing on the Order.

For the following reasons, FPL hereby requests that the NRC extend the time for FPL to request a hearing on the Order, Attachment 2, Items B.2.a(1), B.2.a(2), and B.2.b. FPL is not at this time requesting a hearing on the Order, and is not requesting an extension of time within which to request a hearing on all other Items set forth in the Order.

As required by Condition C.1 of the Order, FPL's response to the Order will provide a status or schedule for implementation of each applicable Item. With respect to Items B.2.a(1), B.2.a(2), and B.2.b, FPL will be proposing a schedule for completion of the necessary evaluations. FPL, however, has not been able to complete the necessary evaluations to determine which actions are appropriate and what an appropriate implementation schedule would be within the 20-day response period.

Because FPL is at this time unable to ascertain what actions would be appropriate to meet the NRC's intent for these Items, FPL will be unable to determine whether it is necessary to request a hearing. Accordingly, FPL requests that the deadline for requesting a hearing on Items B.2.a(1), B.2.a(2), and B.2.b, be extended to 20 days after FPL completes the required evaluation, determines appropriate actions, and sets a schedule for achieving compliance with its action plan. FPL will notify the Commission in writing within 20 days of the completion of these activities.

FPL would appreciate your written concurrence with this request as soon as possible.
