SUBJECT: NRC INSPECTION REPORT NO. 50-395/92-19 Thank you for your response of December 17, 1992, to our Notice of Violation issued on November 17, 1992, concerning activities conducted at your Summer facilit We have examine your response and found that it meets the requirements of 10 CFR 2.20 After reviewing your letter, we agree with your conclusion that item No. 2 of the November 17, 1992, Notice of Violation did not constitute a violation involving inadequate procedures. Accordingly, we will adjust our records to reflect that no violation of regulatory requirements occurred with respect to item No. The basis for your denial of the violation was that the selection of the incorrect switch position was a personnel error and that the procedures for controlling maintenance activities were adequate. Also a labelling deficiency contributed to the personnel error. The inspector's initial concern was that the required switch position was not specified in the equipment tagout instructions resulting in the need for the operator to determine the correct position. Subsequently the inspectors learned that this information may be provided with the equipment tagout, but it is your expectation that operators recognize equipment which is being affected by maintenance activities and specify adequate compensatory measures. Your procedures for equipment control include these expectations as operator responsibilities, in the corrective action portion of your response you addressed the deficient labelling, however, the personnel error issue was not addressed. The inspec-tors were subsequently informed that the individual, a recently promoted shif t supervisor, was counselled by operations management on the event and the responsibilities of shift supervisor Your corrective actions associated with item No. I will be reviewed during future inspection .
