Enforcement Conference An Enforcement Conference was held at the NRC Region I Office, King of Prussia, Pennsylvania, on November 2, 1990.
The conference was held to discuss a security event that occurred on September 11, 1990.
The event, which was brought to the NRC's attention in an allegation made on September 13, 1990, involved the failure to implement all specified personnel search requirements for a short period of time. That event is documented in NRC Combined Inspection Report Nos. 50-317/90-28 and 50-318/90-28, dated October 19, 1990.
In addition, during the conference we discussed a security-related allegation that was received by_the NRC on October 22, 1990, and subsequently was forwarded to you for investigation, and another security event that occurred on October 22, 1990, and involved a deficiency in your access control program as applied to an NRC employee.
The attendees at the conference are listed in Enclosure 1.
During the conference, Mr. C. Poindexter, you and other representatives of the Baltimore Gas and Electric Company (BG&E) discussed the above events, the resulta of your investigation into the September 13, 1990, allegation, and answered questions posed by the NRC staff in attendance. The outline used for the pre-sentation made by the BG&E staff is provided as Enclosure 2.
You confirmed that the September 11 event occurred essentially as documented in our inspection report, and provided a root cause analysis, a review of the corrective actions to prevent recurrence, and an assessment of the factors that mitigate the safety / safeguards significance of the event. That information will be considered in our deliberation of the appropriate enforcement action in this matter. Our decisions vegarding that enforcement action will be transmitted to you by separate correspondence.
With respect to the Octcber 22, 1990, allegation, you confirmed that, in one case, testing for a crucial task, for one security shift, was not conducted in the usual manner, but that the manner in which it was conducted was satisfactory; that you had previously identified that case and had readministered the testing; that the results of the retesting were satisfactory; and that appropriate documentation is available.

September 11 event with the security force, management's actions and the verbage used by security supervision while discussing the event could have been perceived.
as an attempt to identify the alleger, but that management's intent was to caution members of the force regarding the disclosure of Safeguards Information.
Additionally, you explained that the curtailment of overtime was not related to the allegation made to the NRC, but rather that you found individuals' overtime was not being tracted well and, as a result, in some cases exceeded company and NRC guidelines. We accept the results of your investigation and, even though the allegation was partially substantiated, we find no basis for regulatory.
concern since no security requirements appear to have been violated. However, we are concerned about the perception of at least one individual that intimidation was being used to identify an NRC alleger. This matter will be reviewed during our subsequent inspections of your program.
Relative to the security event that involved an NRC employee and a deficiency in your access control program, that event will be addressed in the NRC Resident Inspector's report (50-317/90-29 and 50-318/90-29) covering the period in which the event occurred.
We appreciate the information that was provided during the conference and believe that the meeting was mutually beneficial in understanding and resolving the issues.
