NOTICE OF VIOLATION (NRC Inspection Report Nos.

50-315 and 50-316/89029 (DRP))

This refers to an inspection conducted on October 4 through November 16, 1989, which, in part, reviewed your staff's actions regarding the watchstanding activities of one of the auxiliary equipment operators (AEO) at the D.C.

Cook Nuclear Plant Units I and 2.

Your staff's review of the AEO's activities concluded that for a period of approximately one week prior to October 12, 1989, the AEO had intentionally failed to conduct some area tours while signing log sheets to document that the area tours were performed.

The area tours in question, which provided for monitoring the status of certain safety-related equipment, were required to be performed by procedure OHI-4013.

Adherence to OHI-4013 was required by Technical Specification 6.8. l.a through reference to Regulatory Guide 1.33, Appendix A.

Based on your staff 's review of these activities the AEO's employment was subsequently terminated and a program of random audits of procedural compliance was implemented.

NRC Inspection Report 50-315 and 50-316/89-029 (DRP), which was previously sent to you in a letter dated December 6, 1989, concluded that a Notice of Violation (Notice) was not required to be issued for this violation.

However, in cases involving willful misconduct such as this case, the NRC Enforcement Policy stipulates a Notice will be issued.

Because your corrective actions for the violation contained in the enclosed Notice have already been reviewed, no response to the Notice is required.

It is our understanding that should your company receive proper written inquiries regarding the former AEO from prospective employers, they wi 11 be informed, as a matter of policy, that he was terminated for cause.
