Enforcement Conference No. 50-309/90-18 This letter r-fers to the Enforcement Conference that was held on

October 18, 1990, in our Region I office - The purpose of the Conference was to discuss a potential violation involving a. fitness-for-duty (FFD) related event, which was reviewed during our initial inspection of your FFD program and which is documented in NRC Region I Inspection Report Number 50-309/90-18.

The attendees at the conference are listed in Enclosure l'.-

During the conference, your staff presented a history af the Maine Yankee FFD program, a description of the event, which they confirmed was essentially as is

'

documented in our inspection report, a root cause analysis,:a review of the corrective actions taken to prevent recurrt ace, 'and Maine Yankee's-assessment of the safety significance of the event, The outline for the presentations is enclosed (Enclosure 2).

'

We found the information provided to be very -helpful in determining the proper enforcement sanction to be applied.

In-particular, we considered your strong commitment to the NRC's FFD rule, your aggressive. audit program to-ensure the effective implementation of your FFD program, and your prompt and l

comprehensive actions to prevent recurrence of the event.

W_ e have determined that the event represents a Severity Level IV, violation.as an isolated-failure to meet a basic element of the FFD program.

That decision also considered the f;110 wing:

at about the time of the event, over 1300 test results had been

,

correctly processed, over one-half of which were processed in about a_30-day I

,

i l

period preceding the time of the improperly processed test. result; and, since l

that time, over 1100 test results have been processed without error.

In addition, we determined that the violation meets the criteria in the NRC's l

Enforcement Policy,Section V.G.1 for enforcement discretion; therefore, we are a

'

treating this as a non-cited violation. ;40twithstanding the foregoing, we want to reiterate the serious nature of our concern over this event and caution you

~

that similar occurrences in the future may result in escalated enforcement l-action.

Your staff advised us during the conference of two inaccuracies documented i_n

'

our report of the inspection concerning details of your random testing procedure.

Both inaccuracies appear in paragraph 8.a. on page_11 of'the report. The second sentence of that paragraph states, "A-list'of persons to be

That sentence should read, "A list of persons to be tested randomly is generated by a computer each day from a pool of all Maine Yankee employees in addition to all contractors with unescorted access to the station." The fifth sentence of that paragraph states, "In that case, a

I specimen is collected at corporate headquarters." That sentence should read,

"In that case, the individual must report to the site collection station for testing within a pre-established time limit."
