In your June 8,1990 letter you responded to an apparent violation identified in my letter of May 8, 1990.. Your response stated that you do not believe a
violation of NRC. requirements occurred as was stated in.the Notice of
. Violation. After consideration of your response, we agree that the stated violation did not occur and it will be withdrawn.
The-statement of what your requalification program permits for exemptions is
'
contradicted by 10 CFR 55.59(a)(2) which requires a Part 55 licensee to poss a comprehensive written eatamination atid an atinual operating test.
It is our understanding that' only one individual, a simulator instructor, did not in this past year complete the examination requirements of 10 CFR 55.59(a)(2).

This individual must be' precluded from assuming any licensed reactor operator
' duties until all of the requirements of 10 CFR 55.59(a)(2) are satisfied.
Further, your revised description of your licensed operator recertificaticn course does not appear to satisfy these requirements.
Contrary to tne conclusions reached in your letter dated June 8,1990, each reactor operator

and senior' reactor operator' licensee must pass a comprehensive regt,alification written examination and annual operating test. A violation, which clarifies this fact, is contained in Appendix A, and has been categorized by severity

- Enforcement Actions," 10 CFR 2, Appendix C (Enforcement Policy).
You are
1 required to respond to this letter following the instructions 11 Appendix A.
