This letter is to confirm the agreements reached between Mr. C. Jones, Assistant General Manager for Operations, and others of your staff, and Mr. Karl V. Seyfrit. Director, Region IV, and other members of the Nuclear Regulatory Connission staff on September 4,1981, during the

management meeting held to discuss the results of the NRC Emergency Pre-

paredness Appraisal of Cooper Nuclear Station.

We understand that you intend to take corrective action for the signi-j ficant appraisal findings as stated in the following:

Emergency Response Organization Description i

a.
Required Action The licensee shall revise the Emergency Plan and Procedures to
l unambiguously define and describe the overall emergency response organization and its subcomponents. The description shall identify i

the various groups which make up the overall emergency rexpense organization including: 1) licensee onsite personnel; 2) licensee offsite personnel (e.g., Corporate personnel); 3) Federal response
'
organizations; 4) State response groups for all four states in
the 50 ::ile EPZ; 5) local response groups in the 10 mile EPZ; and 6) contractor organizations and/or individuals on which the licensee would depend for emergency support.

identify the functional areas of emergency response (e.g., accident classification, notifications, oost-accident sampling and analysis, j[

dose assessment and consequence analysis, field monitoring,

Post Accident Sampling i
q a.
Required Action l
It is not clear to the NRC that the licensee can obtain a primary coolant and a containment air sample safely and efficiently. The
licensee shall provide a description of their interim provisions
for post accident sampling and handling methods which describes
obtaining representative primary coolant samples and representative l
containment air samples.
Identify the location and capability of offsite laboratories for radiological analysis of samples taken
'
during an emergency. The licensee shall demonstrate that i
capabilities exist for obtaining post accident samples safely
<
until the permanent post accident sampling system is.initiatcd in accordance with NUREG-0737.

Radiation Monitoring i

describe how personnel in each facility will be made aware of radiological conditions, e.g., radioactive airborne contamination and direct radiation, upon entering the facility and during

occupancy of each facility.

Public Education and Information a.

concerning how they will be notified and what their actions

should be in an emergency. This information shall include educa-tional information on radiation; contacts for additional informa-i tion, protective measures such as evacuation routes and reloca-
tion centers, sheltering, respiratory protection and special
needs of the handicapped.
In the dissemination process, the licensee shall make special provisions to place this informa-
,
i tion at points where the transient population will have access
to it. Further, the licensee shall ensure that preplanned initial and followup messages to the public are available for broadcast immediately following initiation of the alert and notification system and shall identify the individuals by title who are
,
responsible for transmittal of such messages to the radio station i
during an emergency.

The licensee shall submit documentation to the NRC showing that i

7.
Onsite Emergency Organization Augmentation i

Required Action Pursuant to the requirements of the. generic letter dated February 18,-

l 1981 to all licensees from Mr. D. Eisenhut regarding the minimum

staffing requirements for Nuclear Power Plant Emergencies, the I
!
licensee shall provide the results of a study which will demonstrate t
that the 30 and 50 minute staff augmentation for emergencies can be
';
achieved. Results of the study shall be documented and forwarded to the WRC for review and evaluation.

b.
Agreed Upon Date for Completion The licensee shall perform a study to determine shift augmenta-tion according to Table B-1 of NUREG-0654, Revision 1, and submit study results to the NRC by October 5,1981.
8.
Personnel Accountability a.
Required Action The licensee shall demonstrate that the administrative and physical means exist to perform accountability of all persons within the exclusion area within 30 minutes of the start cf the account-ability process and provide continuing accountability of licensee controlled emergency workers thereafter.
b.
Agreed Upon Date of Completion The licensee shall submit by January 15, 1982, corrections of their Emergency Plans and appropriate Emergency Plan Implementation Procedures and submit any additional information deemed necessary to demonstrate that personnel accountability capability exists.
9.
Respiratory Protection a.
Required Action The licensee shall provide resniratory protective equipment for all onsite personnel. The equipment shaP be located in areas safely and quickly accessil e by onsite personnel (e.g. the Control Room, OSCs, TSC, a:.J E0F).
The licensee shall assure the NRC that all personnel will maintain their capability to safely and efficiently don appropriate respiratory protective equip;nent.
b.
Agreed Upon Date for Completion The licensee shall describe how all essential personnel are provided with appropriate respiratory equipment to the NRC by November 5, 1981.
Failure to complete the above required actions by the agreed upon dates will result in NRC considerations of appropriate enforcement action.
In addition to the coninitments noted above, the following issues were discussed at the management meeting held on September 4,1981 and are considered open items pending additional information from Nebraska Public Power District (NPPD).

By October 15, 1981, you are requested to address these issues in sufficient detail indicating how you intend to correct these weaknesses in your Emergency Preparedness Program. Your response shall also include-target dates for com-pleting these actions.
1.
As presently structured it is not apparent that your Emergency Plan provides for a fonnalized classroom training and retraining program for all offsite, corporate and station personnel who may be called upon to respond to an emergency. Provide documentation indicating how this will be incorporated into your overall training program.
2.
Currently your Emergency Plan does not address the long term Recovery Organization. Provide a schedule for revising your Emergency Plan to cover the Recovery Organization.
