Subject: Request for Withholding from Public Disclosure of Paragraph 5 of NRC Region I Inspection Report 50-271/82-07 By your letters dated May 26, 1932 and June 16,1982, you requested that Para-graph 5 of HRC Region I Inspection Report 50-271/82-07 be withheld from public disclosure pursuant to 10 CFR 2.790 because it contained infomation deemed pro-prietary by the General Electric Company. The affidavit forwarded with your June 16 letter and signed by Mr. G. G. Sherwood, however, identified the docu-ment sought to be withheld as the "PCIOMR Implementation Procedures." In a July 7,1982 telephone conversation between Mr. J. T. Wiggins of this office and your-self, you indicated that General Electric deems the infomation'in Paragraph 5 of the subject report to be an integral and important part of the PCIOMR Imple-mentation Procedures and subject to withholding.
Your reason for requesting our withholding of Paragraph 5 of the subject report was that it contains infomation of the type customarily held in confidence by General Electric and not made available to the public. You also state that the infomation contained therein was obtained at considerable expense to General Electric and that its. release would seriously affect General Electric's competi-tive position.
We have reviewed your submittal based on the requirements and criteria of 10 CFR 2.790 and have detemined that the above-mentioned document sought to be withheld contains proprietary commercial infomation.
We have also found at this time that the right of the public to be fully apprised as tc-the bases for and effects of the action does not outweigh the demonstrated concern for protection of General Electric's competitive position. Accordingly, we have detemined that the information should be withheld from public disclosure.
We, therefore, approve your request pursuant to Section 2.790 of 10 CFR Part 2, and are withholding Paragraph 5 of HRC Region I Inspection Report 50-271/82-07 from public inspection as proprietary. Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to in-spect the documents.
If the basis for withholding this infor=ation from public inspection should change in the future, such that the infomation could then be made available for public inspection, you should promptly notify the NRC.
