During an inspection conducted January 7-18, 1980, to detennine ccmpliance of waste shipments from NRC-licensed facilities with applicable DOT and NRC regulations, a shipment from Teledyne Isotopes, Westwood, New Jersey was inspected.

Results: Two items of apparent nonccmpliance with regulations of the

Department of Transportation were identified - failure to provide strong, tight packages and failure to mark several packages.
See paragraphs 3 and 4.
It appears that the Department of Transportation and Region I are tne appropriate organizations to take enforcement action.

The shipment consisted of 149 drums of radioactive materials, sixteen of which were designated as " Limited Quantity," the remainder as " Radioactive LSA."
In addition, there were two test drums containing nonradioactive material.
The 149 packages were from a number of customers of the licensee, principally medical centers in the northeast.
2.
The vehicle was correctly placarded.
The radiation exposure rate at the external surface of the trailer was less than 1 mR/hr.
Wipes of three packages disclosed no removable radioactive contamination.
3.
During unloading of the trailer, two packages were found to have inadequate closures.
The bolt ring of one drum contained no bolt.
The missing bolt was' found on the floor of the trailer.
The bolt ring of another drum had loosened and encircled the body of the drum.
These instances of faulty packaging are not in compliance with the regulations appropriate to the mode of transport of the Department of Transportation in 49 F7R Parts 170-189.
As stated in 49 CFR 173.392(c)(1), materials must be packaged in strong, tight packages so that there will be no leakage of radioactive material under conditions normally incident to transportation.
4-During the unloading, approximately 30 drums were found to have no markings or labels to identify the contents. This is contrary to the DOT regulations in 49 CFR Parts 170-189. As stated in 49 CFR 173.392(c)(8), the outside of each outside package must be stencilled or otherwise marked " Radioactive - LSA".
The unmarked drums were set aside, and the licensee-shipper was notified of the unmarked packages by NECO.
A representative of the shipper visited the burial site on January 17, and marked the unmarked packages, which were then buried.
