NPF-63 WITHDRAWAL OF THE RELIEF REQUEST FROM ASME CODE INSERVICE TESTING REQUIREMENTS FOR THE SECOND 10-YEAR INTERVAL Ladies and Gentlemen:

By letter dated September 7, 2006, Carolina Power & Light Company doing business as Progress Energy Carolinas, Inc., requested a relief request for the Harris Nuclear Plant (HNP), pursuant to 10 CFR 50.55a(a)(3)(i), that would have changed the stated time at which certain check valves are disassembled and inspected from "during refueling outages" to "once per fuel cycle." This change would have clarified the use of online disassembly and inspection of these check valves while maintaining an acceptable level of quality and safety because the proposed frequency was consistent with that of the applicable Code requirement.

During a telephone call with the NRC on April 17, 2007, the need for this relief request to support the second 10-year inservice testing (IST) interval was questioned. Subsequently, the second 10-year IST interval ended on May 2, 2007.

In addition, this relief request is not needed for the third 10-year IST interval.

Therefore, HNP requests withdrawal of the proposed relief request.
