VERIFICATION OF ORDER EA-13-132 - IMPLEMENTATION OF ADDITIONAL SECURITY MEASURES AND FINGERPRINTING FOR UNESCORTED ACCESS FOR PILGRIM NUCLEAR POWER STATION SECOND INDEPENDENT SPENT FUEL STORAGE INSTALLATION

Dear Ms. Sterdis:

The purpose of this letter is to provide written verification that the U.S. Nuclear Regulatory Commission (NRC) has determined that Holtec Decommissioning International, LLC (HDI) has adequately demonstrated compliance with, through an on-site inspection (inspection report [IR]

No. (07201044/2021401), Order EA-13-132, Issuance of Order for Implementation of Additional Security Measures and Fingerprinting for Unescorted Access for Pilgrim Nuclear Power Station Independent Spent Fuel Storage Installation (ISFSI)1 requirements for the Pilgrim ISFSI II. The IR (No. 07201044/2021401) will be publicly available within approximately 30 days of the completion of the inspection on June 17, 2021 (Agencywide Documents Access and Management System [ADAMS] Accession No. MLXXXXXXX). HDI is authorized to use ISFSI II, effective immediately.

1 By letter dated July 23, 2013 (ADAMS Accession No. ML13017A321), Order EA-13-132, Issuance of Order for Implementation of Additional Security Measures and Fingerprinting for Unescorted Access for Pilgrim Nuclear Power Station Independent Spent Fuel Storage Installation, was issued that modified the license for Pilgrim ISFSI. The Order required compliance with additional security measures (ASMs) for physical protection, access authorization and fingerprinting at the ISFSI.

Per Order EA-13-132, the licensee must receive written verification from the NRC that it has adequately demonstrated compliance with Order EA-13-132 requirements before initially placing spent fuel in the ISFSI. On August 12, 2013, the licensee responded to the Order (ADAMS Accession No. ML13234A342). On November 13, 2013 (ADAMS Accession No. ML14008A204), pursuant to 10 CFR 72.212, the licensee notified the NRC that it intends to store spent nuclear fuel at Pilgrim in an ISFSI and intends to use the General License granted under 10 CFR 72, Subpart K, and to use the Holtec International HI-STORM 100 Cask System. Since then, a second ISFSI was built at the Pilgrim Nuclear Power Station, currently referred to as ISFSI II. Order EA-13-132 applies also to ISFSI II.

A. Sterdis 2 On May 12, 2021, the NRC staff issued Amendment No. 254 (ADAMS Accession No. ML21103A055) to Renewed Facility Operating License No. DPR-35, indicating, that:

The amendment is effective immediately. The Physical Security Plan, Rev. 20, except Appendix D, shall be implemented when the required physical security training to address changes from Rev. 19A to Rev. 20 is complete. Appendix D of the Physical Security Plan, Revision 20, shall not be implemented until after the required security training to address changes from Appendix D Rev. 19A to Appendix D Rev. 20 is complete and the licensee receives written verification from the NRC that the licensee has adequately demonstrated compliance with the additional security measure requirements (as applicable to ISFSI II) per Order EA-13-132.

On June 25, 2021, HDI notified the NRC (ADAMS Accession No. ML21176A184) that it completed all required security training per Amendment No. 254. Therefore, upon receipt of this verification letter, and with completion of the required security training, Appendix D of the Pilgrim Physical Security Plan, Revision 20, should now be implemented in accordance with the License.

In accordance with 10 CFR 2.390 of the NRC's "Agency Rules of Practice and Procedure,"

a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
