ACKNOWLEDGMENT OF PACIFIC GAS AND ELECTRIC CORPORATION BANKRUPTCY NOTIFICATION

Dear Mr. Welsch:

This letter acknowledges your letter dated January 29, 2019, informing the U.S. Nuclear Regulatory Commission (NRC) that Pacific Gas and Electric Corporation and its subsidiary Pacific Gas and Electric Company (the licensee for Diablo Canyon Power Plant Units 1 and 2, Humboldt Bay Power Plant Unit 3, and the associated independent spent fuel storage installations (ISFSIs)) filed for bankruptcy under Chapter 11 in Federal Bankruptcy Court on January 29, 2019. Your letter can be found in the Publicly Available Records System component of the NRCs Agencywide Documents Access and Management System (ADAMS) at Accession No. ML19029A020.

The bankruptcy filing does not relieve Pacific Gas and Electric Corporation or Pacific Gas and Electric Company of its obligations to comply with NRC requirements, including those relating to the security and control of licensed material, classified material and information, decontamination and decommissioning of contaminated facilities, and the retention of personnel required by NRC requirements. Additionally, the NRC will continue to conduct inspections of your activities.

The NRC licenses remain in effect, even beyond their stated expiration date, until terminated in writing by NRC. Furthermore, you may not (i) transfer control of any of your NRC licenses without prior written NRC approval or (ii) transfer licensed material, except as authorized by NRC regulations. You should ensure that your attorneys and any trustees involved in the bankruptcy proceeding are aware of these obligations. Any person who takes control of licensed activities or possession of the licensed material, including any contaminated equipment or property transferred by the licensee, must first obtain an NRC license.

Please notify us immediately if you are unable to meet any of these conditions. Also, please notify us when the bankruptcy proceeding is completed.
