RESPONSES TO NRC REQUEST FOR ADDITIONAL INFORMATION FOR REFUELING OUTAGE 1R24 STEA M GENERATOR TUBE INSPECTION REPORT - ENCLOSURE 2, GAE- NRCD-RF-LR-000003 P-ATTACHMENT, REVISION 0 (PROPRIETARY) (EPID L-2023-LRO-0067)

Dear Jamie Coleman:

By letter dated September 22, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23265A249), as supplemented by letter dated January 22, 2024 (ML24022A221), Southern Nuclear Operating Company (SNC, the licensee) submitted information summarizing the results of the steam generator (SG) inspections performed at Vogtle Electric Generating Plant, Unit 1, during refueling outage 24. The SG tube inspection report was submitted in accordance with Technic al Specification 5.6.10, Steam Generator Tube Inspection Report.

By letter dated April 25, 2024 (ML24116A302 - Public, and ML24116A301 - Proprietary), SNC submitted a response to the U.S. Nuclear Regulatory Commission (NRC) request for additional information (RAI) regarding the SG tube inspection report for refueling outage 1R24 for Vogtle Electric Generating Plant (Vogtle), Unit 1.

In Enclosure 1 of the letter dated April 25, 2024, SNC submitted an affidavit dated April 23, 2024, executed by Zachary Harper, Manager, Licensing Engineering, on behalf of Westinghouse Electric Company LLC (Westinghouse), requested that the information contained in the following document be withheld from public disclosure pursuant to Section 2.390 of Title 10 of the Code of Federal Regulations (10 CFR):

Enclosure 2 - GAE-NRCD-RF-LR-000003 P-Attachment, Revision 0 (PROPRIETARY).

A nonproprietary copy of this document contained in Enclosure 3 of the letter dated April 25, 2024, has been placed in the NRCs Public Document Room and added to the NRC Library at the above-referenced ADAMS Accession No. ML24116A302.

The affidavit stated that the submitted information should be withheld from public disclosure for the following reasons:

(5)(a) The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouses competitors without license from Westinghouse constitutes a competitive economic advantage over other companies.

(5)(b) It consists of supporting data, including test data, relative to a process (or component, structure, tool, method, etc.), the application of which data secures a competitive economic advantage (e.g., by optimization or improved marketability).

(5)(c) Its use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing a similar product.

The NRC staff has reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, because of the statements in the affidavit, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.

Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. The NRC staff will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all revi ew situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
