DECOMMISSIONING AND DISPOSITION OF THE URANIUM SUBCRITICAL ASSEMBLY
Dear Dr. Guy:
This letter is in response to our telephone conversation in December 1997, in which you requested information on the procedure for termination of your Special Nuclear Material License. Currently, you are authorized by the Nuclear Regulatory Commission (NRC) for possession only of 900 aluminum-clad, uranium fuel slugs, which make up a subcritical assembly. You have indicated that you intend to transfer this material to the U.S. Department of Energy (DOE). but have yet been ur. successful.
We have contacted DOE on your behalf concerning the disposition of this material. DOE has indicated that it will look into the matter. We will continue to follow this issue and will keep you informed. Because it is unlikely that DOE will take possession of the subcritical assembly before your license expires on November 30. 1998. you should plan to submit a renewal application in accordance with 10 CFR 70.33.
Prior to 1993. you were also authorized to possess four Plutonium-Beryllium (Pu-Be) sealed sources, which have been transferred to Los Alamos National Laboratory's Pu-Be Source Recovery Program. It is our understanding from conversations with you that these Pu-Be sources and the uranium fuel slugs !
have never leaked. (The uranium fuel slugs are considered sealed sources O because the uranium is contained in the aluminum cladding.) Therefore, to terminate your license, you are required to do the following:

- 1. Submit notification .to the NRC as required under 10 CFR 70.38(d):
- 2. Transfer to the NRC the decommissioning records discussed in 10 CFR 70.25. 70.38 and 70.51:
- 3. Dispose of the licensed material in accordance with NRC requirements (in this case, by transfer to DOE):

- 4. Demonstrate that the sources used never leaked through records of leak -
tests or perform a radiation survey to demonstrate no leakage of-activity: and
- 5. Submit NRC Form 314. " Certificate of Disposition of Materials." or equivalent information.
In this case. a decommissioning plan would not be required. However, if you determine that the sources used may have leaked, a decommissioning plan may be required if the procedures and activities necessary.to carry out the decommissioning could increase the potential health and safety impacts to the workers or the public as specified in 10 CFR 70.38(g)(1).
-It is our understanding that you also have nuclear materials licensed by the State of Washington. Termination of your NRC license would not be affected by continuing use or possession of these materials. Further guidance on decommissioning requirements can be found in NUREG/BR-0241, "NMSS Handbook for Decommissioning Fuel Cycle and Materials Licensees."
