TRANSFER OF SUBCRITICAL ASSEMBLY FROM SEATTLE UNIVERSITY TO THE DEPARTMENT OF ENERGY

Dear Mr Thompson:

This letter is in reference to a telephone conversation between you and Susan Chotoo of my staff during the week of April 20. 1998. During that conversation, you indicated that the Department of Energy (DOE) has the necessary documentation on the ownership of the subcritical assembly possessed by Seattle University to move forward with the transfer of the assembly to DOE.

Seattle University currently holds an NRC storage-only license for this material, and the NRC is interested in facilitating timely decommissioning of this facility. Therefore. I would like to request that you provide us with a schedule for the transfer of this material.

1 In addition to Seattle University, the University of Florida in Gainesville and Purdue University are also licensed by the NRC to possess DOE special nuclear material and intend to transfer this material back to DOE. The University of Florida has a storage-only license for 4200 SPERT F-1 type fuel pins (147.8 kg of U-235 contained in UO2 pellets encased in seal-welded stainless steel tubes). Purdue University has a license for the storage and j use of SPERT fuel rods containing uranium enriched to 4.8 weight percent U- I 235 fuel rods containing uranium enriched to 1.3 weight percent U-235. and natural U02 pellets clad in aluminum.

The University of Florida and Purdue University have been unsuccessful in establishing a transfer schedule with DOE. Please inform us on how this may 9906030158 990520
