ENCLOSURE 1 NOTICE OF VIOLATION General Electric Docket'No. 70-1113 Wilmington, NC License No. SNM-1097 During. the Nuclear Regulatory Comission (NRC) inspection conducted on May 23-27, 1988, violations of NRC requirements were' identified. In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the violations are listed below:

A. License Condition 9 of Special Nuclear Material (SNM) License No.1097 requires that licensed material be used in accordance with statements, representations, and conditions of Part 1 of the License Application

' dated October 23, 1987.

Part I, Section 2.2.1.4 of the licensee's application for license No. SNM-1097 requires that radiation protection function activities be conducted in accordance with written procedures.

Nuclear Safety Instruction (NSI) 0-4.0, Rev. 24, dated August 24, 1987, requires all change room instrumentation to be inspected as prescribed by schedule. Appendix A of NSI 0-4.0 requires performance checks to- be performed each shift and the results entered into the instrument log.

Nuclear Safety Release / Requirement (NSR/R) Control No.1.1.23, Old Decon Room, Rev.1, dated November 13, 1985, requires the roll up door in the Old Decon Room to remain closed except during transfer of material to and from'the Old Decon Room.

Contrary to the above, the licensee failed to follow procedures in that:

1. For the period reviewed from May 16, 1988, through May 24, 1988, performance checks of survey meters located in the men's main change room were not routinely conducted each shift.
2. On May 23, 1988, the roll up door between tne radiation controlled Old Decon Room and an adjacent uncontrolled area was not closed and materials were not being transferred to or from the room.

This is a Severity Level IV violation (Supplement IV).

B. 10 CFR 20.103(a)(3) states that for purposes of determining compliance with the requirements of this section, the licensee shall use measurements of radioactivity in the body, measurements of radioactivity excreted gBISo199880727 C ADOCK 07001113 PNU

General Electric 2 Docket No. 70-1113 Wilmington, NC License No. SNM-1097 from the body, or any combination of such measurements as may be necessary for the timely detection and assessment of individual intakes of radioactivity by exposed individuals.

Contrary to the above, the licensee failed to adequately assess individual intakes of radioactivity by exposed individuals in that:

1. For records reviewed from January 1,1988, through May 27, 1988, numerous positive urinalysis results were identified for which no investigations nor uptake calculations were performed.
2. For a February 10, 1988, incident, the investigation and subsequent uptake calculations were based on an urinalysis sample collected at an improper time interval following the exposure event.

This is a Severity Level IV violation (Supplement IV).

Pursuant to the provisions of 10 CFR 2.201, General Electric Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector, General Electric Company, within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a "Reply to a Notice of Violation" and should include [for each violation]: (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time. If an adequate reply-is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.
