October 31, 2002 EN-02-053 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Individual: Ms. Patricia A. McGinn (IA-02-022)

Subject:

ORDER PROHIBITING INVOLVEMENT IN NRC-LICENSED ACTIVITIES (IMMEDIATELY EFFECTIVE)

This is to inform the Commission that an Order Prohibiting Involvement in NRC-Licensed Activities will be issued today to Ms. Patricia A. McGinn. Ms. McGinn, as Human Resources Coordinator at RCM Technologies, formerly Cataract, (Cataract/RCM) was responsible for performing and managing background investigations regarding potential unescorted access authorizations for Cataract/RCM employees contracted to several power reactor licensees. The Order is being issued because Ms. McGinn deliberately falsified background information for various individuals in support of granting unescorted access authorizations at Tennessee Valley Authority (TVA) facilities and Indian Point 2 and Millstone in the 1997 time frame. It should be noted that none of the affected individuals would have otherwise been denied unescorted access.

The Order requires that Ms. McGinn not engage in NRC-licensed activities for a period of three years, and provide an answer to the Order within 20 days of its date.

It should be noted that the individual has not been specifically informed of this action.

The individual has 20 days from the date of the Order to request a hearing.

In separate, related actions also to be issued today, a cited Severity Level IV violation will be issued to Cataract/RCM and letters granting Exercise of Enforcement Discretion will be issued to TVA (Watts Bar, Sequoyah, and Browns Ferry), Indian Point 2, and Millstone for being in violation of the unescorted access authorization requirements. These actions recognize that Cataract/RCM and the licensees are ultimately responsible for the actions of their employees and contractors.

Cataract/RCM and the affected licensees are being notified of the respective actions today.
