CONFIRMATORY ORDER EFFECTIVE IMMEDIATELY This is to inform the Commission that the staff expects to issue a Confirmatory Order (Effective Immediately) on or about January 31, 2006, to Entergy Nuclear Operations, Inc., Indian Point Units 2 & 3. This action is based on the requirements of PL-109-58, 119 Stat 594, Section 651, 170E(3)(b) of the Energy Policy Act (Act) of 2005, that directs the Commission to require that backup power is to be available for the emergency notification system of the power plant, including the emergency siren warning system, if the alternating current supply within the 10-mile emergency planning zone of the power plant is lost. The Confirmatory Order will become effective immediately upon issuance. This confirmatory order will be issued immediately following the staffs receipt of the licensees consent and hearing waiver which is expected shortly.
