ISSUANCE OF NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation (NOV) associated with a White Significance Determination Process finding will be issued on or around May 1, 2014, to Tennessee Valley Authority (TVA), as a result of the failure to maintain plant staffing levels in accordance with the radiological emergency plan at Browns Ferry Nuclear Plant (BFN). This White finding, an issue with low to moderate significance to safety, which may require additional NRC inspections, involved the failure of the licensees process for maintaining minimum emergency response shift staffing to adequately maintain staffing of the Shift Technical Advisor (STA) and Incident Commander to ensure initial accident response in all key functional areas.
Additionally, NRC identified two examples of violations of 10 CFR 50.9 based on the licensees failure to provide complete and accurate information associated with emergency response on-shift staffing requirements and an violation of 10 CFR 50.90 for the apparent failure to submit an application requesting an amendment to their operating license concerning on-shift staffing levels.
In response to the preliminary determination letter, TVA agreed with the NRCs characterization of the apparent White finding, associated with an apparent violation of 10 CFR 50.54(q), which requires licensees to follow and maintain the effectiveness of an emergency plan that meets the planning standards of 10 CFR 50.47. TVA responded to the apparent violations of 10 CFR 50.9 and 50.90 by requesting Alternative Dispute Resolution (ADR). It is not common for an enforcement case to include both Reactor Oversight Process findings and ADR.
Immediate corrective actions taken to restore compliance included correcting the Conduct of Operations procedure to reflect adequate staffing levels. TVA also agreed, as a result of mediation, to comprehensive fleet-wide and plant-specific corrective actions.
