March 4, 2015 EN 15-008 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Tennessee Valley Authority EA-14-003 Sequoyah Nuclear Plant Docket No. 50-327; 50-328

Subject:

NOTICE OF VIOLATION AND PROPOSED IMPOSITION OF CIVIL PENALTY - $70,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $ 70,000 will be issued on or about March 9, 2015, to Tennessee Valley Authority (the licensee). This action is based on a Severity Level (SL)

III Problem involving missed fire watches and failure to exercise supervisory duties and subsequent falsification of procedurally required paperwork, which occurred in October and November of 2012.

The first violation represents a violation of 10 CFR 50.48, Fire Protection, by willfully failing to have proper oversight of fire watch activities and willfully failing to conduct roving fire watch patrols in the Emergency Diesel Generator Building. The second violation is against 10 CFR 50.9(a), Completeness and accuracy of information, by completing fire watch records when in fact fire watches were not being performed.

In accordance with the Enforcement Policy, a base civil penalty in the amount of $70,000 is considered for a Severity Level III problem. Because the licensee has been the subject of escalated enforcement actions within the last 2 years and because the violations were willful, the NRC considered whether credit was warranted for Identification and Corrective Action. Credit was not warranted for identification.

However, credit for corrective action was warranted. The corrective actions included:

(1) suspension of unescorted access for the six individuals identified; (2) development and implementation of a Fire Watch/Route Accountability Log; (3) establishment of a pre-job brief each shift; and (4) revision to Sequoyah processes.

The licensee was given the opportunity to: (1) respond in writing, (2) request a PEC, or (3) participate in an ADR mediation session. The licensee provided a written response.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
