ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White Significance Determination Process (SDP) finding will be issued on or around January 26, 2005, to the Tennessee Valley Authority (TVA) as a result of inspections at the Sequoyah Nuclear Plant, Unit 1. This White finding, an issue of low to moderate safety significance that may require additional NRC inspection, involved the failure to promptly identify and correct binding problems with the Siemens breaker mechanism operated cell (MOC) slide assembly for the 1A Residual Heat Removal (RHR) pump.

A Notice of Violation is included based on a violation of the requirements of 10 CFR 50, Appendix B, Criterion XVI, Corrective Action, in that TVA failed to promptly correct this condition adverse to quality. Specifically, TVAs actions in response to the previous MOC linkage problems and the vendors discovery of the binding problem in April of 2004 did not constitute adequate corrective action to preclude the failure of the 1A RHR breaker, which resulted in the failure of 1A RHR pump to start during surveillance testing.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

The licensee has 30 days from the date of the letter in which to respond.
