NRC OFFICE OF INVESTIGATIONS REPORT NO.3-2001-0056

Dear Mr. Nazar:

This letter refers to an investigation conducted by the U.S. Nuclear Regulatory Commission (NRC), Region III (RIII), Office of Investigations (OI) to determine if a former employee was discriminated against for raising issues. Based on the evidence developed during the investigation, we did not substantiate this issues. The allegation summary and investigation result summary is enclosed. If you have any questions or comments regarding this matter, please contact James Heller or Ken Lambert of the NRC Region III staff at telephone number (630) 829-9500.

In accordance with 10 CFR 2.790 of the NRCs "Rules of Practice," a copy of this letter, its enclosure, and your response, if any, will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). In addition, final NRC documents, including the OI report, may be made available to the public under the Freedom of Information Act (FOIA) subject to redaction of information pursuant to the FOIA.

ENCLOSURE An individual believed that s/he was the subject of discrimination for rasing safety issues.

Specifically, the individual stated that s/he was: (1) reassigned from a job assignment for raising inadequacies with design change packages; (2) threatened by a supervisor to not discuss action plans and condition reports that s/he had written; and (3) fired after raising concerns about the air-operated valve program.

The evidence developed during an investigation conducted by the NRC Region III Office of Investigations (OI) did not substantiate that an individual was: (1) reassigned from a job assignment for raising inadequacies with design change packages; (2) threatened by a supervisor to not discuss action plans and condition reports that the individual had written; and (3) fired after raising concerns about the air-operated valve program.
