MID-CYCLE PERFORMANCE REVIEW AND INSPECTION PLAN - TURKEY POINT NUCLEAR PLANT

Dear Mr. Stall:

On August 14, 2007, the NRC staff completed its performance review of the Turkey Point Nuclear Plant for the first half of the calendar year 2007 assessment cycle. Our technical staff reviewed performance indicators (PIs) for the most recent quarter and inspection results over the previous twelve months. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility.

This performance review and the enclosed inspection plan do not include physical protection information. A separate letter designated and marked as Exempt from Public Disclosure in Accordance with 10 CFR 2.390 will include the physical protection review and a resultant inspection plan.

Overall, Turkey Point Unit 3 operated in a manner that preserved public health and safety and fully met all cornerstone objectives. Plant performance for Turkey Point Unit 3 for the most recent quarter as well as the previous three quarters was within the Regulatory Response Column of the NRCs Action Matrix based on a White inspection finding in the Mitigating Systems Cornerstone and a White inspection finding in the Initiating Events Cornerstone. A White finding associated with a loss of all decay heat removal during a period of reduced reactor coolant inventory. This White inspection finding, involving the Initiating Events cornerstone, reflected performance at a level requiring increased regulatory response.

Therefore in addition to the reactor oversight process baseline inspection program, a Supplemental Inspection using Inspection Procedure (IP) 95001, Inspection for One or Two White Inputs In a Strategic Performance Area, was conducted the week of April 9, 2007, and no findings of significance were identified.

Plant performance for Turkey Point Unit 4 for the most recent quarter as well as the previous two quarters was within the Licensee Response Column of the NRCs Action Matrix, based on all inspection findings being classified as having very low safety significance (Green) and all PIs indicating performance at a level requiring no additional NRC oversight (Green).

FPL 2 Additionally, plant performance for both units for the third quarter of the calendar year 2006 was also within the Regulatory Response column of the NRCs Action Matrix due to a White finding associated with extended inoperability of the B Auxiliary Feedwater Pump due to an incorrectly installed bearing. This White inspection finding, involving the mitigating systems cornerstone, reflected performance at a level requiring increased regulatory response. A Supplemental Inspection using Inspection Procedure (IP) 95001, Inspection for One or Two White Inputs In a Strategic Performance Area, was conducted the week of May 15, 2006 and no findings of significance were identified.

In our end-of-cycle assessment letter, dated March 1, 2007, we noted that you had initiated actions, and had additional actions planned, to address the cross-cutting issue. One of the key corrective actions, the conversion of their work processes to the Passport System, will not take place until 2009. The inspectors have reviewed some of the actions and have seen improvements. An additional PI&R team inspection was conducted and identified three Green NCV findings in Spring 2007. Since some of the corrective actions have not been in place long enough to demonstrate their effect, we determined that this cross-cutting issue remains open.

Based on conversations with members of your staff, we understand that you plan to make a presentation in the Region II office to our staff in October 2007 to discuss your ongoing actions to address your action plans for the safety conscious work environment (SCWE) and safety culture survey and improvement project for corrective action program. The NRC staff will evaluate the effectiveness of these initiatives at the end of CY 2007 through a focused 71152 inspection. If staff review shows the above plans to be effective and the licensee no longer meets the criteria for a substantive cross-cutting issue as described in Manual Chapter 0305, this substantiate cross-cutting issue will be closed at the 2007 end-of-cycle assessment.

The enclosed inspection plan details the inspections, less those related to physical protection, scheduled through March 31, 2009. Please note that we will be also conducting inspections related to the Independent Spent Fuel Storage Installation that is planned for your site and we will coordinate with you the dates of the inspection. In addition to the ROP baseline inspections, we plan to conduct non-baseline inspections involving Units 3 and 4 containment sump blockage. The inspection plan is provided to minimize the resource impact on your staff and to allow for the resolution of any scheduling conflicts and personnel availability issues well in advance of inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature. The inspections in the last twelve months of the inspection plan are tentative and may be revised at the end-of-cycle review.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).

The NRC is currently evaluating the scope and frequency of all baseline inspection procedures.
