ORDER The San Luis Obispo Mothers for Peace (SLOMFP), as part of its request for hearing in this proceeding, petitioned for waiver of 10 C.F.R. § 51.53(c)(2) and 10 C.F.R. Part 51, Subpart A, Appendix B, to the extent that these regulations preclude the litigation of its proposed Contention EC-2, which relates to the environmental impacts of spent fuel storage.1 As part of its recent decision granting SLOMFPs hearing request, the Atomic Safety and Licensing Board found that SLOMFP had demonstrated a prima facie case for waiver, and certified the matter to the Commission.2 To aid in its determination on the merits of the waiver petition, the Commission invites the parties to submit briefs addressing the question whether 10 C.F.R.

§ 51.53(c)(2) and 10 C.F.R. Part 51, Subpart A, Appendix B should be waived to permit litigation of Contention EC-2.

1 Under 10 C.F.R. § 51.53(c)(2), a license renewal applicant need not discuss in the environmental report any aspect of the storage of spent fuel for the facility within the scope of the generic determination in 51.23(a) and in accordance with 51.23(b).

As admitted, Contention EC-2 states: [Pacific Gas & Electrics] Environmental Report is inadequate to satisfy [the National Environmental Policy Act] because it does not address the airborne environmental impacts of a spent fuel pool accident caused by an earthquake adversely affecting [Diablo Canyon]. Id. (slip op., Attachment A).

Initial briefs are limited to 40 pages, exclusive of the title page, table of contents, table of authorities, and any supporting materials, and must be submitted no later than Friday, September 24, 2010. Thereafter, the parties may file responsive briefs, of no more than 15 pages, exclusive of the title page, table of contents, table of authorities, and any supporting materials, no later than Friday, October 15, 2010. Arguments made before the Board need not be repeated.

This Order is issued pursuant to my authority under 10 C.F.R. § 2.346(a).
