On January 21, 2015, after oral argument concerning petitions by Friends of the Earth (FoE), the Boards Chairman received an ex parte e-mail from Dr. Michael Peck, an NRC employee acting independently on his own behalf. At Judge Ryersons request, the Office of the Secretary served the e-mail on the parties and placed it in the docket.1 On January 30, 2015, the NRC Staff submitted a motion requesting that Dr. Pecks e-mail not be considered by the Board.2 FoE opposes the motion3 and Pacific Gas & Electric Company (PG&E) supports it.4 1

On its own initiative, the Board has determined not to consider Dr. Pecks e-mail, and the Staffs motion is therefore moot. Pursuant to 10 C.F.R. § 2.315(a) the role of an interested person who is not a party to a proceeding is extremely limited. In the discretion of the Board, a person who is not a partynor affiliated with or represented by a partymay be permitted to make a limited appearance by making an oral or written statement within the limits and on the conditions established by the Board.5 If allowed, such statements shall not be considered evidence in the proceeding.6 In this instance, the Board did not make available an opportunity for limited appearance statements. Even if it had, Dr. Peck as an NRC employee would have been prohibited from participating due to his affiliation with the NRC Staff. Even if permitted, Dr. Pecks e-mail could not be considered as evidence.
Therefore, the NRC Staffs motion concerning Dr. Pecks e-mail is denied as moot.
It is so ORDERED.
