The oral argument that was originally scheduled for May 24, 2023,1 but that was postponed due to unforeseen exigent circumstances,2 will be held on Tuesday, June 13, 2023, beginning at 1:00 p.m. Eastern Time (ET). The oral argument will address standing and contention admissibility issues presented in the hearing request filed by San Luis Obispo Mothers for Peace (SLOMFP) seeking to intervene in Pacific Gas and Electric Companys (PG&Es) application to renew its license for the independent spent fuel storage installation at the Diablo Canyon Nuclear Power Plant.3 Consistent with the initial Scheduling Order, see supra note 1, the June 13, 2023 oral argument will be held in-person in the Atomic Safety and Licensing Board Panels Hearing 1 See Licensing Board Scheduling Order (Scheduling Oral Argument on Standing and Contention Admissibility) (Apr. 14, 2023) (unpublished).

Room at the Nuclear Regulatory Commission (NRC) Headquarters, 11545 Rockville Pike, Rockville, Maryland, 20852. The Board anticipates that the oral argument will not exceed 2 and 1/2 hours. Members of the public who wish to attend should enter NRC Headquarters through the One White Flint North Building, arriving early enough to proceed through security and to be escorted to the Hearing Room. Members of the public who wish to listen to the oral argument on a listen-only telephone line should contact the Boards law clerk, Noel Johnson, at noel.johnson@nrc.gov, during the week of June 5, 2023 for the telephone number and passcode. If you previously contacted the Boards law clerk for the listen-only telephone number and passcode, she will send you the new number and passcode during the week of June 5. For other interested members of the public, the argument will be transcribed, and the transcript will be placed in the NRCs electronic hearing docket, which can be accessed at https://adams.nrc.gov/ehd/.

This Board will hear from counsel for SLOMFP, counsel for PG&E, and counsel for the NRC Staff, in that order. Each individual will be allotted 40 minutes to present oral argument and answer questions. Counsel for SLOMFP may reserve up to 10 minutes of allotted time for rebuttal. Counsel should keep in mind that this Board has read their written pleadings.

Accordingly, their presentations should focus on the principal points in controversy and endeavor to provide responsive answers to the Boards questions.
