. COMES NOW the undersigned Intervenor, Pro Se, and in representatio of Citizens For The Conservation Of Natural Resources, Inc. ( CCNR ), collectively referred to os Intervenors, and respectfully states, alleges and prays : ,

e 1.- That on April 10th,1981, the Appeal Board granted Intervenors until May 15th, 1981, to file on appeal under 10 CFR I 2.762 with regard to the Licensing Board's' Memorandum and Order of February 18th,1981, which granted Applicant's Motion For Termination of Fro-ceeding And The Withdrawal of Application Without Pregudice.

. 2.- That this Notice of Appeal is hereby filed with regard to the above, and intervenors take exception to the following :

e A.- Granting Applicant's Mction for Termination of Proceeding.

. B .- Granting Without Prejudice The Withdrawal Of Aoplication.

. C.- Ignoring The Fact That This Was The Second Time Apolicant Withdrew its Application.

e 3.- That the above exceptions are limited to discussing Licensing Board's errors, to wit :

e A.- Whether to terminate the Proceeding while there is still pending a contro-

e B.- Whether it was a sound discretionary judgment to grant without prejudice the withdrawal of the Applicatior, while disregarding the actions and situation of Applicant throughout the six year proceeding and the import of such circumstances to the public interest.

4 e C.- Whether disregarding the fact that this was the second time Applicant withdrew its Application was a sound discretionary judgment in accord with applicable legal -

doctrines and case law when granting the withdrawal of the Application without prejudice.

e 4.- That it is now uncertain when oil the evidence necessary for completing the appeal brief will be made available to Intervenors. The affidavits referred to in our pleading of April 6th,1981, p.3, are being processed and will be forthcoming within the thirty (30) day period setforth in 10 CFR 2.762(a). With regard to the investigation of Applicant's operations referred to in our pleading of April 25th,1981, p.3, which has been undertaken since April 10th,1981, by the Department of Justice, a request was made by letter on May 7th,1981 to the Secretary of Justice ( Ses EXHIBli "A" )* Finally, the necessary research on case law for supporting argu-ments presents no problem because such information is available in any Law School Library. Now, the difficulty in obtaining NRC lssuances is aggravated by tlye NRC Staff Counsel's refusal to facilitate the requested information ( See EXHIBIT "B" ). In any event it will be some time be-fore Intervenors, for no fault of their own, con gather the necessary information to prepare their i

Appeal Brief, perhaps as long as over one year.-

e WHEREFORE, Intervenors respectfully pray the Appeal Board : (1 ) - To accept the above Appeal as timely f;Ied and thus, to ackowledge its iurisdiction to deal with thereof. ( 2 ) - To hold in abeyance the thirty (30) day period to file a Brief in support of the foregoing exceptions t

  • A similar request was also made on May 8th,1981, to the Hon. Jos6 Granados Novedo, Chair-man of a House Special Committee Investigating Bribery in Applicant's Operations ( EXHIBIT "C")

The findings of such a Committee are just as relevant to intervenors Appeal as it is the results of the Department of Justice's final report on the so,me subject.

Nuestra organizaci6n --sin fines de lucro -es Interventora en el procedimiento que se sigue en la Junta At6mico de Seguridad y Licencias de la Comisi6n Reguladora Nuclear, en relaci6n con una solicitud de la Autoridad de Energia E16ctrica (AEE) que est6 pendiente de adjudicaci6n, sobre el proyecto de la Planta Nuclear en Arecibo.

El 11 de septiembre de 1980 la AEE retir6 su solicitud ante dicho Junto mediante la cual persegura el prop 6sito de obtener licencia para construirel reactor nuclear. El 18 de septiembre de 1980 los Interventores pedimos a la Comisi6n al desestimar dicho solicitud to hiciera con periuicio. La AEE, desde luego, se ha venido oponiendo a ello.

Nuestra 61timo gesti6n ante dicha Junta ( V6ase moci6n que se acompc6a fechado i

25 de abril de 1981 ) se refiere en la p6gina 3, entre otros cosas, a una investigaci6n que se supone lleva a cabo el Departamento de Justicio sobre alegada corrupci6n en las operaciones de dicha agencia gubernamental.

Por este medio solicitamos de usted con toda la formalidad de rigor que en su dia, cuando haya concluido la investigaci6n, se nos sirva copia del informe oficial del Departamento de Justicia sobre la misma.

De existir alg0n impedimento respecto a lo aquisolicitado, le agradeceria que se nos informara a su m6s pronia convenciencia.
