of Citizens for the Conservction of Naturci Resources, Inc. ( CCNR ), collectively referred to es Interveners, end respectfully stetes, clieges end preys :
.1.- Thct on June 1,1981, received on June 6,1951, the Apoect Becrd denied intervenors' Recuest For An Extension Of Time To File Brief, filed by meil on Mcy 12, 1981.
In said piecding Intervenors sought that the thirty (30) dcy period to file Brief be held in ebey _

cnce until thirty (30) deys efter such time the Deprtment cf Justice end Legisictive investige-tions of Applicent's clieged corrupt operations cre mcde eveilcble te Interveners. Inte veners' o
li piecding cisc suggested ther the Investigations in question, cireedy underwey, could take es long es one year. The Appecl Bocrd, however, grcnted intervenors en eighteen (18) dcy ex-tension of time to file Brief, thet is, until July 3,1981.
I The Appect Socrd's ORDER stetes ther " Interveners' " recuest is opcesed by beth the cpplicent end the NRC steff." interveners hereby inform the Apoecl Bocrd for the record that l.
Applicent's Respons e of Mcy 21, 1981 wcs indeed received. NRC Steff's Respense, howeve,

Doubtfully, it could hcve been ecused by meil fcilure, since ther would hcve been en unprecedented cese in the six yecrs the pcrties to this croceeding hcve ' een serving c
pcpers to ecch other by mcil$* Beccuse of the greviousness cnd consequence of NRC Steff's failure to serve their Response to Interveners, this Petition is submitted with the express recuest ther the Apcect Bocrd ORDER cn investigation of the non-service incident end subsecuently take the corrective mecsures deemed necesscry.

e 2.- Thet intervenors vehemently disegree with the Appeal Socrd's rctionale expreued in the penultimcte peregrcph of its ORDER of June 1,1 CSI cnd thus prey the Appect B6crd 'to reconsider the import end consecuence of this Appeal Bocrd to cer within the egency itself (NRC) perhcps incdvertently cssuming the role of en appelicte ecurt where issues not reised below cannot be reised enew in epoect. Does the Apoect Bocrd mecn that e proven corrupt cpplic=nt would hcve the NRC's doors open to recuest end be gr=nted license te build end opercte o nuclect plant just beccuse the corruption in cuestion wcs not reised during the licensing proceeding be-fore the ASLB7 Does this rulingmeen thct nctioncl scfety cnd public interest with rescrd to nuclecr energy must be dependent on FBI cnd CIA intervention beccuse NRC connet trust itself to be the sole judce in a situction like the present one denounced which demends the most circumspect discretion ? Intervenors resist beliaving thct the cheve questions could be enswered by the Appeci Bocrd in the effirmetive. We would rcther believe thet the ApoecI Bocrd's refusci to look ct the clieged corrupt situction of Applicent, censidering it beyond its jurisdiction, hcs been en oversight end we hope for en imrnedicte correction.
- Besed on the record it is incenceivchle thet NRC Steff's counsel, Henry J. McGurren, Esc.,
nor Applicent's counsel, Mcurice Axelred, Esc.,.would ever de such en unethicci act.

e in obtcining NRC lssvences" referred to in our plecding of Mcy 12,1981. Upon suggestion of the NRC Stcff, Intervenors wrote on Mcy 14, 1981, to the Nctionel Technicci information Service to obtcin e digest of'NRC lssuences, but es of this dcte no reply bcs been received
( See EXHIBIT "A"). Our pledge to NRC Staff on this line hcs been erroneously interpreted as a request for "legel resecrch service " ( See NRC Stcff letter to the undersigned intervenor of May 5,1981 ). Interveners need to look et NRC issucnces en ecses where withdrawels of applications have been grcnted with or without prejudice before we con cdecuct.ely prepcre our Brief.
o 4.- Thct the undersigned Intervenor will be cbsent from Puerto Rico from June 18, 1981 to July 15, 1981, es he is committed to ettend -he Annuct Meeting cf World Feder= lists of Conede end World Government Organizations Coordincting Council on Jane 1 8 - 22, 1 981 for which previous commitment hcs been mede es e perticipant et Brock University, St. Kctherines

e 5.- That under the resent circumstences w here no interest is effected by c deley, since there is no cpplic= tion under considerction by it.e Licensing Boced, due process end public l
l nterest indic=te thct they will best be served by grcnting Intervenors cmple time to present their ccse. Thus, Intervencrs expect no less then en extension of time up te end including September 30, 1 981 to file the Brief.
l e WHEREFORE, Interveners respectfully prey the Appeel Bocrd : ( 1 )- Te reconsider its ORDER of June 1,1981, thus grcnting Interveners en extension of time to file the Brief cni thet i
such extension ef-time be consistent with the chove steted ex;r=crdincry c=uses ; ( 2 ) -To in-vestig=te the non-service of NRC Steff's Response referred to in the Appe=1 Becrd's ORDER cf June 1,1981.
