MOTION TO FILE SWORN STATEMENTS FROM OWNER-RESIDENTS OF THE ISLOTE NUCLEAR PLANT ABOUT DAMAGES INFLICTED UPON THEM BY APPLICANT TO THE HONORABLE APPEAL BOARD :
. COMES NOW the undersigned Intervenor, Pro Se, and in representation cf Members of Citizens for the Conservation of Natural Resources, Inc. ( CCNR ), collectively referred to as intervenors, and respectfully s'ates, clieges end prays :
e 1.- That pursuant to Intervenors' announcem'e'nt in their pleadings of April 6,1981, April 25,1981 and May 12,1981, the attached eight (8) sworn statements' original version in Spcnish and trenslation to English, numbered I to 8 inclusively, are hereby submitted for tFe Appeal Board's consideration. No more offidavits have been taken since they would have been repetitive, occumulative evidence and too costly to Intervenors. The encbsed offidavits m no way substitute Intervenors' Brief for which filing an extension of time for extraordinary ccuse was filed on June 6,1981. -
e 2.- That as previously sted, the sworn statements are filed as evidence of 'Le sort of domoge to public interest which would be caused and would remain lotent if Applicant's appli-cotion dismissal without pre [udice were to be sustained in oppeal. Motion to file Sworn Statements... June 13,1981 that "oppeal from the Licensing Board's order must be founded on the record before that Board."
In the American Judiciary, however, it is a longstanding doctrine thct new evidence which was not known during the adjudicatory proceeding and which could have offected the decision rendered, can be raised in appeal and even in a petition for reheoring.
. WHEREFORE, Intervenros respectfully pray the Appeal Board to accept the enclosed sworn statements and thus in due time give them due consideration.

- SWORN STATEMENT I, Daniel Reyes Olmo, of legal ege, married, by occupation farmer, resident of Arecibo, Puerto Rico, and member of the environmentalist organization, Citizens for the Conservation of Natural Resources, Inc., Arecibo Chapter ( CCNR ), under oath STATE
1.- That my name and personal circumstances are as stated above.
2.- That I have a share of 6{ty percent (soM) on the real estate propert located at Islote Word of Arecibo, that term < ,;crt of the inheritance essets of the n I.eo'y Rojas and Maria Rojos Esta te. -
3.- That in 1975 the Water Resources Authority, now called the Electric Energy Authority ( EEA ) expropriated the aforementioned property for the reason thct it planned to build there a Thermo-Nuclear Plant.
4.- That I was not in ogreement with either letting said property be expropriated or with the oppraisci made by the EEA.
5.- That I did not accept the sum of money cppropricted to my nome et the Superior Court of Puerto Rico, San Juan Sectic.,, by the EEA for the compulsory expropriction of my property.
6.- That recently Mr. Nelson Cerrasquillo, Chairman of CCNR, Arecibo Chapter, informed me that the EEA hcs not given ut the plans to build in the future a Nuclear Plant in Islote Word. Among the evidence presei ted to me by Mr. Corrasquillo that estchlishes without a shadow of a doubt : hot EEA main ains the Nuclear Plant project in Islote Word of Arecibo !ctent, i quote the following : (o 1 - That the EEA requested the Nuclear Regulatory Commission to prepare a Final Environmen'al Impact Stdtement of the Nuclear Plant project in Islote, and in April,1977, said federc' agency produced scid repcrt, that is, approximately eight months ofter the EEA had notified m of the desistance of the expropriction of my land.

1.- That my name and personal circumstances are es stated above.
2.- That I am the brother of Leopoldino Rojas Natal, who died on November 5,1974.
3.- That I am convinced that the death of my sister was caused by the way in which the Water Resources Authority ( WRA ) octed when exproprioting the property in which she lived.
4.- That my sister lived all her life in Islote Ward on her own form.
5.- That since she was notified by employees of the WRA that her form would be exproprioted and that she most move, her hecith began to fail.
6.- That the day my sister died, employees of the Water Resources were doing soil tests and making a lot of noise.
7.- That I told the employees of WRA to stop the machines since the noise they were making was aggravating the condition of my sister.
8.- That in spite of my pledge, they continued working until the moment my sister deceased.

1.- That my nome and personal circumstances are as stated above.
2.- That I have a share of one esph ('/s) part on the real estate property located at Islote Ward of Arecibo, that terms part of the inheritance assets of the Jose" Antonio Rss PirleiroEstate.
3.- That in 1975 the Water Resources Authority, now called the Electric Energy Authority ( EEA ) expropriated the oferementioned property for the recson that it planned to build there o Thermo-Nuclear Plant.
4.- That I was not in egreement with either letting said property be expropriated or with the appraisal made by the EEA.
5.- That I did not cceept the sum of money appropricted to my ncme at the Superior Court of Puerto Rico, Sen Juan Section, by the EEA for the compulsory expropriction cf my Property.
6.- Thet recently Mr. Nelson Corresquillo, Chairman of CCNR, Arecibo Chapter, informed me that the EEA hcs net given up the plans to build in the future c Nuclear Plant in Islote Word. Among the evidence presented to me by Mr. Corrcsquillo that establishes without a shadow cf a doubt that EEA maintains the Nuclecr Plent project in Islete Word of Arecibo Ictent, I quote the following : (a) - That the EEA requested the Nuclear Reguictory Commission to prepare a Final Environmental Impact Statement of the Nucicer Plant project in Islote, and in April,1977, said federal agency produced said report, that is, approximately eight months ofter the EEA had notified me of the desistance of the exproprictiori of my land.
The Summary and Conclusions of said report says, inter clio, with regard to the same : "in the determination of the suitebility of the Islote site for eventual construction by the Puerto Rico Water Resources Authority ( EEA ) of the North Coast Nuclear Station..." ( Emphasis added ) ;
(b) - That a document filed by the EEA in the Atomic Safety end Licensing Board ( ASl8 )
entitled : " Authroity's Reply to Intervencrs' Reply ", dated December 31, 1981, in pages 5 ond 6 states :
" the matter of importance was not the precise status of expropriction proceedings but whether the Authority possessed the power of eminent domain end thus would be able to acquire the site, if and when it aro- l ceed with the croiect. * * *
- Cessotion of the exprcpriction process in mid-1976 did not offect the Authority's power of eminent domcin, which continued to exist and could egoin be exercised if and when the oroject [of the Nuclecr Picnt in Islote 3 went forwcrd." ( Emphois added). I l
(c) - That the EEA has firmly opposed through four extensive motions dated October 3,1980, I December 31,1980, March 12, !981 and April 17, 1981, latervencrs' metien dated September 18, 1980 in which it is requested from the Nuclear Regulatcry Commission that the EEA's cppli-cotion for license to build a Nuclear Picnt in Islote, withdrcwn on September 11,1980, be dismissed WITH PREJUDICE.

1 SWORN STATEMENT I, Almaranto Rojos Robles, of legal age, married, by occupation former, and resident of Arecibo, Puerte Rico, under oath state :
1.- That my name and other personal circumstances are os mentioned above.
2.- That as a result of the actions of the Water Resources Authority ( Now, Electric Power Authority ) related to soil tests and exprpriation of some for the construction of a nuclear plant at Islote, Arecibo, I suffered substantial demoges.
3.- That among the non-compensated donages I suffered are the following :
(a ) - I lost a half (1/2) cuerda of cossovo crop that I had planted, due to the fact that employees of the Water Resources Authority possed heavy equipment over the planted field while making soil tests.
( b ) - [That ] by approximately 1974 I was building a house on my land and the Water Resources Authority compelled me to stop said construction olleging that my land would be expropricted.
( c ) - That I had to pay penalty and interests on property taxes which I did not
[ timely 3 pay because employees of the Water Resources Autl.:r y had informed me that my land would be expropriated for the construction nf a nucleo plant in Islote, Arecibo, Puerto Rico. ,,

- 6. Que recientemente el Sr. tielson Carrasquillo, Presi-dente de CPCRN, Capitulo de Arecibo, me inform 6 de que la AEE no ha abandonado la consideraci6n de construir en un futuro La i
