. COMES NOW the undersigned Intervenor, Pro Se, and on behalf of Members of Citizenz for the Conservation of Nctural Resources, Inc. ( CCNR ), and respectfully states alleges and prcys :

.1.- During the last two decades the cbove-captioned project hcs been kept I active. Documents made available to the Intervenors prove conclusively that Applicant l

had dropped its intention to build North Coast Nuclear Plant ever since August 5,1976.

During those last four years Applicant has been filing with the ASLB pro forma status reports.

On December 28,1979, Applicant requested the period for submission of status reports be changed from four months to twelve months cnd such request was granted on' February 19, 1980. Besides the fact that no other cpplication for nuclear plcnt licensing seems to have been kept active for such a long period without accomplishing anything, it is a serious offense in which Applicent incurs by hiding information from the ASLB and intervenors cbout the underlying reason for not dropping the cpplication once the decision wcs taken not to build the nuclect plant. plant ill fated venture has inflicted upon the economy of Applicant.

1 e 2.- Intervanors have been gathering inforrnation to prove conclusively that Applicant has no legitimate intention to pursue the application and that , os stated above, the rooson it is kept olive is entirely irrelevant to the purpose which once was seriously -

sought to build a nuclear plant in Puerto Rico. To wi.t :

( A ) - In 1974 and 1975 the Applicant expropriated the tracts of land required for the construction of the above-captioned project, including the so-called exclusion

area. The corresponding expropriation cases granted at the Court of Expropriation of the l Superior Court of Puerto Rico appears filed under dockets numbers: E74-1019 ; E74-1020 ;

i E74-1021 ; E 74-1022 ; E74-1023 ; E74-1024 ; E75-528 ; E75-529 ; E75-530 ; E75-531 ;

! E75-532 ; E75-533 ; E75-534 ; E75-574 ; E75-575 ; E75-576 ; E75-577 ; E75-578 ;

E75-579 ; E75-580 ; E75-581 ; E75-582 ; E75-583 ; E75-584 ; E75-585 ; E75-586 ;

E75-897 ; E75-898 ; E75-899 ; E75-900 ; E75-901 ;- E75-902 ; E75-903 ; E 75-904 ;

E75-905 ; E75-906 ; E75-907 ; and E75-908. However, as early as August 5,1976, b :

l l plicant comrnenced filing Motions of Desistance on all the above numbered cases desisting i

from exproprioting the land involved and requesting the Court of Expropriation that upon ,

refunding of the money paid by Applicant to the various land owners, the title of the land be reverted to them. Sample of one of those motions translated to English is enclosed, EXHIBIT ",

So for most of the land where supposedly the nuclear plant will sit bs been returned to the original owners, save a few cases which for legal technicality have not been completely prog cessed yet.

( B ) - Applicant's Official Financial Statement dated JUNE 30 , 1 979, indicateq that the Authority had incurred in costs to that date for the nuclear plant project of the sum l

Docket No. 50-376 30 April,1980 of $154,959,000, yet it has written down the costs to $ 5,931,000 ( EXHIBIT "B" ).

Intervenors believe that the reason Applicant has written down the costs and hangs on to the application for licensing before the ASLB in spite of desisting to build the nuclear plant is that to carry out a loss of $155 million would have on adverse effect on the sole of Power Revenue Bonds.

( C ) - The Interim Report of the Committee on Energy Alternatives for Puerto -l Rico, dated just 1979, prepared by the National Research Council of the National Academy of Science, referred to in the Applicant's status reports,* states, inter olio :  ;

" A plant of over 600 megawatts' capacity would be undesirably large in relation to the total copocity of the WRA system * * * * ~

Such a unit should not exceed 450 megowetts in capacity, and probably should be smaller. That constraint, in combinationwith the need to have the unit in operation in the next decade, rules out the use of nuclear power." ( EXHIBIT "C" ) ( Emphasis added).

i ( D ) - The Report of the Governor of Puerto Rico to the Legislature of January 31, 1980, the part regarding Puerto Rico's Electrical System is totally silent about nuclear-energy, yet it speaks about different sources of energy which are being studied for future use, none of which is nuclear energy, EXHIBIT "D".

( E ) - The Energy Policy of Puerto Rico, o document dated June,1979, prepared by the Office of Energy of Puerto Rico ottoched to the Governor's Office, raises serious doubts about the use of nuclear energy because of the many unanswered questions related j- to such technology, mainly, waste disposal, avoilobility of uranium, costs of shutdown of reactors, etc. ( EXHIBIT "E" ).

  • Applicant's status reports only refer to o study undertaken by the National Academy of l

Science on contract by the Government of Puerto Rico. Status reports have remained silent

( obout any adverse findings such as the one quoted above.

Nuclear Project .

In 1970 the Authority entered into a contract for the construction of a 613.MW nuclear generating plant for installation at A;uirre. In fiscal 1974, nuclear plant development at the Aguirre site was discontinued when it was determined that the site did not comply with revised seismological licensing requirements, and a location near Arecibo was chosen. In December 1975, the Authority postponed indefinitely the construction of the Arecibo plant although it is continuing its erTorts to license that site in g a

order to maintain its option of constructing a nuclear plant in the future. In December 1978, the Authority cancelled the contract for the manufacture of nuclear plant equipment.

For information relating to the canying value and effects of write downs of nuclear equipment, see Note (8) to Notes to the Financial Statements in Appendix 1.

Notes On September 30.1979, the Authority had outstanding S200.3 million interim financing notes issued under a S245.3 million line of credit with Government Development Bank. Of such notes, S195.3 million are held by several b.nks under a note purchase agreement (see" Note Purchase Agreement" below) and mature on December 31,1983. See Note (2) to Notes to the Financial Statements in Appendix 1. Such notes included S30.0 million of notes issued in August 1979 to refund the same amount of notes issued to three commercial backs in 1977. The refunded notes, which were' issued to pay for equipment, were repayable in five senuannualinstallments ending August 31,1981.

Proceeds of the Series F Power Revenue Bonds in the amount of $95.8 million will be applied to the payment of outstanding notes held by banks under the note nrchase agreement. The Authority plans to issue additional notes to finance capital improvements. See ": x. Year Program" under Projected Capital improvement and Financing Program.

Included under Notes is $32.2 million of notes issued under the $60.0 million lines of credit extended in July 1979 to the Authority by Citibank ,N. .A and The Chase Manhattan Bank (N tia onal Association) 18 .

The Authority has a pension plan covering all qualified employees, which is administered by the Employees' Retirement System of Puerto Rico Water Resources Authority, an entity created by authorization of the Authority's Governing Board. The total pension cost for the year ended June 30,1979 was 523,300,000 (including the portion allocated to utility plant) of which approximately S11,500,000 represented prior service costs. Unfunded past service liability is being amortized over a 40. year period -

from June 30,1975, and current contribution is substantially funded as incurred. At June 30,1978 (date of the last actuarial report) the plan had accumulated benefits.in excess of net assets as follows:

The most significant actuarial assumptions used as of June 30,1978, are: (a) retirements are assumed ,

to occur at the rate of 100% among those members eligible to retire between ages 60 and 65 or after the completion of 30 years of creditable services, (b) interest rate of 5%, compounded annually, (c) level j normal cost and open end liability, (d) assumed annual rates of future salary increases and (c) use of a 1963 mortality table by the actuary.

(8) Nuclear plant:

From 1970 to 1979, the Authority spent approximately S34,947,000 'r' elated to site and licensing for a

nuclear plant which was originally planned to be located on the south ^ coast of Puerto Rico.1.icensing of that site, however, became unattainable under revised regulations, and a new licensable site 'was obtained 1 on the north coast of Puerto Rico. The Authority is taking the necessary steps to comply with all the appropriate licensing requirements in order to main'ain its option of constructing a nuclear plant in the future. Costs iri:urred in connection with the licensing requirements, which in the opinion of management are of continued benefit to the development of a nuclear or other plant, aggregate $21,004,000, and are g included in construction work in progress.

In addition, the instal'ition of the Authority's nuclear plant equipment has been postponed pending resolution of matters such as disposition of waste materials, and other technological, environmental and licensing requirements. During December,1978, the Authority rescinded the contract for the installation of the nuclear plant equipment. The costs incurred 'o date of 553,094,000 have been written down to S5,931,000, which amount, in the opinion of management ahd its Consulting Engineers, is realizable through the sale of the nuclear plant equipment if the Authority should decide to do so.
