By letter dated October 8, 2007 (Agencywide Documents Access and Management System Accession No. ML072830023, not publicly available), Nebraska Public Power District (NPPD) provided an amended response related to compliance with Section B.5.b of the February 25, 2002, Interim Compensatory Measures (ICM) Order, EA-02-026. Your amended response also provided a regulatory commitment that addressed Element B.2.m.2 of the U.S. Nuclear Regulatory Commission (NRC) Phase 1 guidance for achieving satisfactory compliance with Section B.5.b of the ICM Order.
The NRC staff has reviewed the information provided by NPPD in your October 8, 2007, letter and concludes that your regulatory commitment provides reasonable assurance that Cooper Nuclear Station will remain in compliance with Element B.2.m.2 of the NRC Phase 1 guidance.
