On January 10, 2012, ZS responded to the Order (Reference 2) providing an estimated completion date for the Independent Spent Fuel Storage Installation (ISFSI) construction of December 2012, with the transfer of spent fuel and Greater-Than Class C (GTCC) low level waste from Zion Nuclear Power Station to the ISFSI set to occur in February 2013. Additionally, ZS stated that draft procedures and plans would be available by December 20, 2012 to demonstrate compliance with Attachment 1 and 2 of the Order.

Subsequent to ZS's January 10, 2012 response to the Order, ZS's ISFSI construction and spent fuel/GTCC waste transfer schedules have been delayed. Because of this schedule adjustment, draft procedures and plans necessary to demonstrate ZS's ability to comply with the Order have also been delayed. ZS will implement the provisions of the Order as part of the ISFSI security plan implementation in advance of ISFSI operations. Currently, ZS's acceptance and NRC's inspection of the ISFSI security program and systems is scheduled for mid-2013. The draft procedures and plans necessary to demonstrate compliance with the Order will be available within a reasonable time prior to support these NRC inspection activities and well in advance of 101 Shiloh Boulevard, Zion

ZionSolutions, LLC ZS-2012-0521 Page 2 of 2 the first spent fuel dry cask storage canister being placed on the ISFSI pad. Full implementation of these procedures and plans will be completed before placing the first spent fuel dry cask canister on the pad.

In accordance with 10 CFR 72.4, ZS is notifying the State of Illinois of this response to NRC Order EA-1 1-268 by transmitting a copy of this letter to the designated State Official.
