STATE OF VERMONTS NOTICE OF ANTICIPATED WITHDRAWAL OF THE STATES PETITION FOR LEAVE TO INTERVENE AND HEARING REQUEST The State of Vermont submits this filing to provide notice that it anticipates withdrawing its June 13, 2017 petition for leave to intervene and hearing request.

On March 2, 2018, the State signed a Settlement Agreement (attached here) with a number of interested parties, including the Applicants for license transfer of the Vermont Yankee Nuclear Power Station. That Settlement Agreement addresses concerns that the State raised in its petition for leave to intervene and hearing request, and, so long as the Settlement Agreement remains in place, the State will withdraw its petition for leave to intervene and hearing request.

This filing is a notice of anticipated withdrawal, rather than an immediate withdrawal, because the Settlement Agreement includes a provision (paragraph 13) that allows a party to withdraw from the Settlement Agreement if the Vermont

Public Utility Commission materially alters the terms of that Agreement or does not issue an order by July 31, 2018 approving the proposed transaction and incorporating the terms of the Agreement substantially in their entirety. Once the opportunity to withdraw from the Settlement Agreement has passed, and assuming the Settlement Agreement remains in place, the State will submit its formal notice of withdrawal from this proceeding.
