On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to yourSeptember 25, 2006, letter received in our office in December 2006. (To expedite the NRC's response to a request for a fee waiver in the future, please send your letter to me directly in accordance with 10 CFR 170.5). Your letter requested a fee waiver under the provisions of NRC regulation 10 CFR 170.11 for the review of the topical report, WCAP-16308-NP, "Pressurized Water Reactor Owners Group 10 CFR 50.69 Pilot Program - Categorization Process - Wolf Creek Generating Station." Based upon a review of the request, I am granting a fee waiver for the NRC review of this report in accordance with the applicable provisions of the NRC regulation. The objective of your report is to provide a real case categorization process for review andpotential endorsement as an alternative approach within the Regulatory Guide (RG) 1.201, "Guidelines for Categorizing Structures, Systems, and Components in Nuclear Power Plants According to their Safety Significance." Based on a review of your submittal, the NRC staff believes that the topical report will be used by the NRC as a basis to support generic improvements to the RG 1.201. Per 10 CFR 170.11(a)(1)(iii)(A)(1) and 170.11(a)(1)(iii)(A)(2),

fees are not required for the NRC's review of a topical report that was submitted for the purpose of supporting the NRC's development of generic guidance and regulations, and at the time the document was submitted, the NRC planned to use it for that purpose.
