REVISED RESPONSE TO TASK INTERFACE AGREEMENT - DIABLO CANYON SEISMIC QUALIFICATION CURRENT LICENSING AND DESIGN BASIS, TIA 2011-010 (TIA 2012-012) (TAC NOS. ME9840 AND
ME9841) The purpose of this memorandum is to update the guidance found in Task Interface Agreement (TIA) 2011-010 dated August 1, 2011 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML112130655). TIA 2011-010 documents the Office of Nuclear Reactor Regulation's (NRR) concurrence with Region IV's position that new seismic information developed by the Pacific Gas and Electric (PG&E, the licensee) is required to be evaluated against all three of the seismic design basis earthquakes at Diablo Canyon Power Plant (DCPP)
- 1. After the issuance of TIA 2011-010, two additional documents have been issued that essentially supersede the guidance found in TIA 2011-010. These documents are:
- U.S. Nuclear Regulatory Commission (NRC) request for information dated March 12, 2012, that was sent to all nuclear power plant licensees pursuant to paragraph 50.54(f) of Title 10 of the Code of Federal Regulations (10 CFR) (ADAMS Accession No. ML12053A340) requesting a reevaluation of seismic hazards .
- NRC letter to PG&E dated October 12, 2012 (ADAMS Accession No. ML120730106), that informed the licensee of the results of the review of the Shoreline fault, and placed the NRC's review of the Shoreline fault into context with the action for all nuclear power plant licensees to perform seismic reevaluations in accordance with the request for information dated
March 12, 2012.
The NRC staff's current position regarding expectations for addressing new seismic information is documented in the request for information dated March 12, 2012, and the NRC letter to the licensee dated October 12, 2012. The staff's position that supersedes the guidance found in TIA 2011-010 is as follows:
1 The three DCPP design basis earthquakes are the Design Earthquake (DE), the Double Design Earthquake (DDE), and the Hosgri Earthquake (HE).
- In its letter dated October 12, 2012, the NRC staff noted that new information regarding the Shoreline fault can be found in PG&E's letter dated January 7, 2011 (ADAMS Accession No. ML110140431), and that the Shoreline fault is evaluated by the NRC in Research Information Letter 12-01, "Confirmatory Analysis of Seismic Hazard at the Diablo Canyon Power Plant from the Shoreline Fault Zone" (ADAMS Accession No. ML121230035). The NRC's letter dated October 12, 2012, states that the Shoreline scenario should be considered as a lesser included case under the Hosgri evaluation and the licensee should update the
Final Safety Analysis Report Update, as necessary, to include the Shoreline scenario in accordance with the requirements of 10 CFR 50.71(e).
- The NRC's letter dated October 12, 2012, provides guidance that for purposes of the response to the request for information dated March 12, 2012, the staff expects PG&E to use the DDE for comparison with the reevaluated seismic hazard ground motion response spectrum (GMRS) that is being developed to respond to the request for information. The NRC's letter dated October 12, 2012, notes that the request for information provides guidance for licensees to follow if the GMRS exceeds the safe shutdown earthquake or DDE for DCPP.
- The NRC's letter dated October 12, 2012, and the request for information dated March 12, 2012, provide guidance for assessing new seismic information and what PG&E is expected to do in the event that it becomes apparent that the new seismic information will lead to a GMRS that is higher than the DDE.
Longer term, it should be noted that the NRC staff plans to address Recommendation 2.2 of the Japan Lessons Learned Near-Term Task Force (NTTF), which states:
Initiate rulemaking to require licensees to confirm seismic hazards and flooding hazards every 10 years and address any new and significant information. If necessary, update the design basis for systems, structures, and components important to safety to protect against the updated hazards.
Therefore, expectations related to collection and assessment of new seismic hazards information would likely be addressed as part of this response.
Based on the above, the NRC staff considers that the guidance found in TIA 2011-10 has been superseded by the guidance for assessing new seismic information at DCPP found in the NRC's letter dated October 12, 2012, and the request for information dated March 12, 2012.
