SUBJECT:

HOLTEC INTERNATIONAL'S APPLICATION FOR CONSOLIDATED INTERIM SPENT FUEL STORAGE FACILITY LICENSE IN LEA COUNTY, NEW MEXICO, DOCKET NO. 72-1051

Dear Ms. Morgan:

I am writing in response to your letter to Chairman Svinicki and Commissioners Baran and Burns dated February 26, 2018. In your letter, you forwarded a letter from nine members of the State of New Mexico's Senate, requesting the U.S. Nuclear Regulatory Commission (NRC) to extend the public comment scoping period related to Holtec International's proposed Consolidated Interim Storage Facility license application. In the letter, the legislators explained that the typical 45-day comment period would conclude before the New Mexico Legislature has had the opportunity to hold public hearings, receive expert testimony, get citizen input and make scoping recommendations. The legislators also requested that the NRC leave the scoping comment period open until after the end of the next full legislative session in 2019, to allow the New Mexico legislature and state agencies an opportunity to fully review critical issues in the appropriate legislative interim committees and make policy recommendations that can be included as scoping comments.

As requested in your letter, enclosed for your information is a copy of the NRC staff's response to the letter from the State of New Mexico Legislators. If you would like to discuss any of these matters, please contact John McKirgan, Chief of the Spent Fuel Licensing Branch, at

(301) 415-5722.

Sincerely, /RA/

Victor M. McCree Executive Director for Operations
