ANSWER OF APPLICANT IN RESPONSE TO NOTICE OF HEARING Arkansas Power & Light Company, Applicant in the above-styled matter, by and through its undersigned attorney, files this Answer in response to the " Notice of Hearing on Application for a Provisional Construction Permit", pursuant to 5 2.705 of the Commission's " Rules of Practice",10 CFR Part 2.
The Applicant admits that due and proper Notice of Hearing has been published in the Federal Register by the Atomic Energy Commission, as required by $ 2.104 of the 8004280 g g-G-
Commission's " Rules of Practice", 10 CFR Part 2 Applicant does not controvert, but concurs in the findings which the Director of Regulations proposes to make on the four items set out in the Notice and admits all facts necessary to make those findings.
Applicant will appear at the public heartng at 10:00 a.m. , local time , on October 30, 1968, in the Young Student Center, Arkansas Polytechnic College, Russellville, Arkansas, and will at sucn hearing assume and carry forward the burden of proof, by competent, relevant and substantial evidence, for an affirmative finding on Item Numbers 1 - 3 and a negative finding on Item 4 of the items and issues eet forth in said Notice of Hearieg. Applicant's evidence will be a legally sufficient basis and record (i) to fully support the findings proposed to be-made by the Director of Regulations so that the issuance of a permit for the construction of Applicant's facility will not be inimical to the ccmmon defense and security nor to the health and safety of the public, and (ii) .for the issuance of the provisional construction permit 2-
