On September 26, 2012, the State of New York (New York) filed an unopposed motion for an extension of time, requesting that New York, Riverkeeper, Inc. (Riverkeeper), and the State of Connecticut (Connecticut) be granted until November 9, 2012, to file rebuttal testimony and Interested Governmental Entity (IGE) statements of position concerning Contention NYS-38/RK-TC-5.
1 Entergy Nuclear Operations, Inc. (Entergy) and the NRC Staff do not oppose this extension request.
2 Finding New York's request will have no adverse impact on the hearing schedule, the Board revises the schedule for filings concerning Contention NYS-38/RK-TC-5 as follows:
a) Revised Statement of Position/Rebuttal Testimony and IGE 3 Initial Statements: November 9, 2012 1 Unopposed Motion for Extension of Time Due to Unavoidable Circumstance (Sept. 26, 2012) at 1. 2 Id. at 3. 3 Although this request was only made on behalf of IGE, Connecticut, the revised schedule applies to all parties wishing to participate on Contention NYS-38/RK-TC-5.
b) Motions in Limine/Motions to Strike Concerning November 9, 2012 Filings: January 7, 2013 c) Entergy/NRC Staff Responsive Testimony concerning IGE Initial Statements: January 7, 2013 d) Answers to Motions in Limine/Motions to Strike: January 17, 2013 e) Proposed Questions for the Board to Ask and Motions for Cross Examination: February 6, 2013 f) Answers to Motions for Cross Examination: February 19, 2013 It is so ORDERED.
